Gun Violence Reduction Executive Actions
Today, the President is announcing that he and the Administration will:
1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.
2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.
3. Improve incentives for states to share information with the background check system.
4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.
6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.
7. Launch a national safe and responsible gun ownership campaign.
8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).
9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.
10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.
11. Nominate an ATF director.
12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.
13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.
14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.
15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies
16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.
17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.
18. Provide incentives for schools to hire school resource officers.
19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.
20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.
21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.
22. Commit to finalizing mental health parity regulations.
23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

Other than that, good shit. Although I disapprove of the use of executive orders. Most of these I can agree with.

IAC, to me, it shows the duplicity on all sides. It seems more about ACA and what is and is not covered, how much they can pry into lives, share records, etc.

I commented in another thread that Doctors are now supposed to rat on their innocent patients while lawyers are still forbidden to turn in their criminal clients...

Oh yeah, there is a lot of subtle pushing on the slippery slope, but it seems fairly sideways, but downwards, I agree. But, all this stuff is already there in State laws.

We need to get ahead of it. What can that be? The Next Election.

And, IAC, does it force them or does it remind that it is allowed? Some State already require these reports.

The potential problem, as I see it, is the collection of all this combined heath and gun data for the supercomputers to mine.

No gun ban will happen. The fact this is what we got from Biden's threat of executive order says a lot. Most gun legislation has to go through congress, even the most supported legislation which is universal background checks which in basic terms means banning privates sales, will have a tough time getting through. Out of the executive stuff we just have more spending by government, nothing that limits or bans anything. And out of the gun legislation being pushed in congress, I really can't see any of it getting through. I say this not as a gun owner but a political observer and a person with common sense.
1.Assault rifle ban? Less then 1% of all gun murders are committed with assault rifles. In fact of all gun murders in 2009, 2010 and 2011 which is about 34,000, only about 1,000 were committed by ALL rifles, and less then 1/3 were committed by assault rifles. Why are they going after the type of firearms that kill the least people?
2. Ban magazines over 10 rounds? The difference between one handgun shooter emptying 4-10 round mags and another emptying 2-20 round mags is about 5-6 seconds. Would that 5-6 seconds really make a difference? It took over 20 minutes for the police at Columbine and Sandy Hook to respond.
The two above are supposedly the MAIN REASON for the gungrabbers fight. So the least used weapons and 5-6 seconds. This in their minds will prevent gun violence.
Just a note-I thought Obama having kids in the background and then going over to them and high-fiving after his speech was a disgusting but typical act from a politician. I'm surprised Biden wasn't there grabbing the kids and spinning them into the air.

After re-watching Obama's speech. I kind of gathered that. It'll be hard for them to get the ban through. Bad time to buy now though. 3-5x the price. Price gouging is in full swing.

it does not frighten me. It violates the doctor patient priviledge and forces doctors to act as psychiatrists and report people to law enforcement. What happens next? A chat with law enforcement? Unreasonable search and seizure for the good of the *patient*?

But somehow, people who have been charged with crimes can say anything they want to their lawyers with no consequences.

Now, if it is supposedly for the children and for safety do you see a problem with the above scenario?

Taking a weapon away from a potentially crazy person does not prevent them from obtaining another weapon. The directive is intrusive and a violation of privacy in addition to be an unwanted burden on the doctors who are now forced to carry out the commandments of the president due to the Obamacare doctrine.

It will be near impossible to get any bans through, but if one watches national media news networks or visits CNN online it sounds as if 90% of the public is for gun confiscation and Obama/Biden are winning the battle. Nothing could be further from the truth, but of course the truth rarely matters in politics.
Yes. I have quite a few stripped AR lowers I could of sold for 400 each, paid 75 each for them the last 2-3 years. It's not even about price gouging anymore. I know a owner of a shop that sells everything and manufactures custom ARs and silencers and they can't get certain basic parts anymore to finish builds because of the fear of the possible ban. The only thing they had for sale were some AR pins and a few Ghillie suits and they have stopped taking orders for custom builds. First time ever in the 36 years of their existence. But I agree, go to armslist for an AR or look for ammo online and the prices are ridiculous. This is normal for the situation we are in. It will pass. By spring/summer firearms and ammo will be back in full force.
I think the only possible ban that may happen will be large magazines and a small number of specific assault rifles, particularly drums and SBRs.
 
As a phys therapist this means I get to decide you might be crazy with my vast psychological training and bend HIPAA over and pound it. HIPAA has been a roadblock to speedy, efficient care that causes layers of repetitive unneeded paperwork. I think it's awesome I get to break for medical reasons I'm not qualified for but face 5 years in prison if I don't dot my I's and cross my T's while doing what I am qualified for.

It also means if there are guns in a household, anyone living there is discouraged from seeking mental health treatment. I absolutely believe the mass-murder cases are mental health issues and not gun issues, but this is riddled with unintended consequences. There will be people who will be afraid to get their 14 year old neighbor cat killer son help because they won't want to lose their guns. Then we'll have crazy untreated people in houses with guns which believe it or not is worse than crazy but treated people in houses with guns.
 
Some people in the medical community think that anyone who does illegal drugs are dangerous. They now get to report you to the authorities as a threat because you smoked a joint. They could be fined if they put 4 letters of your last name on the door instead of 3 but they get to "as healthcare providers" turn you in for a dirty sample.

This policy will be rejected like many other central planning knee jerk emotional "solutions".

There was a 9 month period where JCAHO required providers to ask each person we treated, each time we treated them if they or anyone they knew were assaulted in any way. I treated patients 3 x a week and was supposed to do this every visit. You could be coming to me after tearing an ACL playing hockey, didn't matter, I still was supposed to ask if you had been molested since Teusday.

It's a requirement by gov mandate that we must do a blood alchohol on all drivers of a motor vehicle accident brought to the ER. Makes sense right? Well, ALL by law means a 6 year old will have blood drawn for a drunk test when he flips a 4-wheeler or falls off a mini bike.
