WalMart Fires Associate Of Year, Cancer Patient For Medical Marijuana

Despite medical marijuana being legal in Michigan, WalMart has fired a cancer patient and former employee of the year who tested positive for the drug, which was recommended by his doctor.


"I was terminated because I failed a drug screening," ex-WalMart employee Joseph Casias told WZZM-13.


In 2008, Casias was Associate of the Year at the WalMart store in Battle Creek, Mich., despite suffering from sinus cancer and an inoperable brain tumor.

​At his doctor's recommendation, Casias legally uses medical marijuana to ease his pain.


"It helps tremendously," Casias said. "I only use it to stop the pain. To make me feel more comfortable and active as a person."


Casias said he went to work every day during his five years at WalMart. "I gave them everything," he said. "One hundred and ten percent every day. Anything they asked me to do, I did. More than they asked me to do. Twelve to 14 hours a day."


Then Casias sprained his knee at work last November. During the routine drug screening that follows all workplace injuries, marijuana was detected in his system.


Casias showed WalMart managers his Michigan medical marijuana card, but was fired anyway.


"I was told they do not accept or honor my medical marijuana card," Casias said.


Casias said he never smoked marijuana before going to work.


"No, I never came to work under the influence, ever," he said. "I don't think it's fair. Because I have a medical condition I can't work and provide for my family?"


"In states such as Michigan, where prescriptions for marijuana can be obtained, an employer can still enforce a policy that requires termination of employment following a positive drug screen," said WalMart spokesman Greg Rossiter from company headquarters.


"We believe our policy complies with the law, and we support decisions based on the policy," Rossiter said.


Casias has been collecting unemployment compensation since getting sacked in November, but this week he said he was notified that now WalMart is even challenging his eligibility for benefits.


"It's not fair," he said.


I know I won't be shopping at WalMart anytime soon. Who's with me?

I am with you. I hate Walmart for other reasons too. They treat all of their employees like shit and pay them next to nothing. This is how they are the richest cooperation in the world. They cut costs that do not need to be cut, such as employee medical insurace and other hard earned benefits. Check out the documentary "Walmart: The high cost of low price." It's pretty sweet.

My girlfriend went to apply there as a last ditch effort to find a job she goes to the computer and there is a yellow sign saying "if you use any illegal drug for medical purpose or not do not bother applying for a job." WTF ----I feel bad for this guy that is sad and should be criminal.

Wal-mart doesn't care about ruining a persons livelihood just there bottom line. Everything lies on the medical laws of Mi. If there is a clause then Wal-mart is wrong and a big lawsuit could result. There are lawyers that would take this case in a heartbeat, being a cancer patient and all, but if there is no clause then, it just sucks, donkey dick.

People tried to fight situations like this in California and took it all the way to the Supreme Court citing that how were medical users of marijuana supposed to earn a living as not all medical users were bed ridden and unemployed.

The court basically ruled that since marijuana was illegal at the federal level then all the employers in California were within their right to fire those who tested positive for THC.

The bottom line is its going to take marijuana being made LEGAL at the federal level ...OR...at least being re-scheduled as a Schedule II class drug like Morphine, Oxycontin, Dilaudid, Fentanyl, Demerol,Methadone, ect.

If someone takes a drug test ...either random or pre-employment and they have a prescription for Oxycontin for example, and they show that to the drug testing doctor and the doctor lets the employer know of the drug resulting in the drug tested person being fired or not getting hired, then its an EASY lawsuit against both the doctor and employer.

This is what MMJ users need badly is protection from job termination. At least marijuana being re-classified in the same group as narcotic opiates in the Schedule II class, this would impact drug testing labs from divulging when a drug screened person tested positive for THC when they had the proper MMJ registration.

As long as things stay as they are , there will be no job protection for random or pre-employment drug screens, its going to take re-scheduling of marijuana at the bare minimum.

I do hope that this Walmart worker Joe Casias has a fighting chance in court. Walmart has proven they have no compassion by all the sweat shops they have in China and South and Central America , as someone previously said...watch Walmart: The High Cost of Low Prices ,.... the Walton Family who owns Walmart are some evil greedy bastards who deal and profit from the suffering and misery of others.
 
Wow! That's fucking unbelievable! I wonder if they would of fired him if he took morphine for his pain and tested positive for opiates. I mean it's shitty that people even get fired for testing positive for marijuana without a medical reason, but that guy was suffering and they r still gonna fuck his life! This is a disgrace, have a goddamn heart. Walmart sux anyways and this totally makes me wanna boycott them. I think the guys should sue because he has a medical reason and make a big problem out of this.
