So my buddy is getting divorced and it’s getting messy.

He received papers about three weeks ago and apparently she took a picture of a picture on his phone of my garden. She is accusing him of being involved so she has a better chance of getting sole custody of her kids. No mention of names there. But then she goes on and says in a later part that he was buying pills from me (which isn’t true I don’t do pills). Just first name I don’t think she knows my last. And she doesn’t know where I live.

I’m 50/50 on ripping everything out of the ground right now.

Thoughts?

man id cut.... i once had this happen and just barely got everything out into a nearby field till it was over, we did all live in the same house so thats different. but its just as easy to point a finger. keep it legal till it blows over.
honestly how many times do these things end well? and how crazy are some parents/people.
(my plants sat in 100+ degree foothills for 3 days in garbage bags, and the funny thing is i stuffed em back in the ground and only lost one hahahha)

I wouldn't jump the gun. It will likely take months before any kind of investigation would start if one did at all.

If she doesn't know your full name or where you live the cops aren't going to waste time looking for some small grower. Unless your buddy had his location turned on his phone then the location will be embedded in the EXIF file with the pictures. Can be pretty damn accurate.

Toss a coin.

If your exposed to risk, consider your options.
Taking some easy to hide clones and turning the rest to honey oil is one of those options. If it's all in veg absolutely cut imo.
all it takes is them putting the screws to your "friend" to get your details.

And there's no such thing as friends.

This is what I was thinking. Normally, I would agree with @OldMedUser about not jumping the gun but if she's trying to implicate you in manufacture/distribution/sales of anything, LE might at a minimum decide to do a knock and talk with you. Maybe Mr. G. lives in a small town and his wife's atty is friends with the police chief or district atty. And we really don't know how much she knows about him. "Better safe than sorry" works for me. ;)

They can always declare it a investigation, then hit him with impeding the investigation for withholding info. There's about 100 ways to make the process happen, they dont have to be honest or follow a set of rules, they just have to scare him.

There is nothing like a woman scorned, I've been through this shit and they'll pull out whatever it takes to get back at you. In my case I made the mistake of being honest and telling her I was done and wanted nothing to do with her, no affairs or the like. A buddy of mine had a similar experience (he got caught cheating though). I just couldn't take her any more and more or less told her so, dumb-ass move that cost me, she dragged it out over 3 years of court battles, even though it cost her in the end. If so inclined, they will not stop until they get some satisfaction that they've somehow gotten back at you.

That said, most of the bull-shit she tried in court was disregarded/thrown out as she had no evidence. Courts don't deal with "he said, she said" crap, they deal with facts. So the question on chop vs. carry on is how much evidence does she actually have that could potentially trigger an investigation.

If I were a betting man I'd call this low-risk in that courts don't have the time for this shit and some form of this scenario comes up in many divorces, they just don't have the time or resources to investigate anything unless it involves violence and clear evidence is put forth (bruising, pics, hospital or police report, history of domestic calls etc.). But as @growingforfun said, how good is this friend of yours and is it possible he'd throw you under the bus?

The only evidence she has is a picture of a picture (attached) and my first name, no address.

She has never seen shit in person and has never been to my home. Also this chick is on drugs and is making up all kinds of stuff in my friends court documents I’ve read...

I’m still 50/50 with it because I have no money saved and am fucked bill wise if I take it down. More fucked IF something were to happen tho.

Yeah not much so it's really down to how much you trust your friend.

My ex had the balls to try and claim that I had abused my kids (they were late twenties when we split, not even at home). It back-fired on her when my son and daughter caught wind of it and signed affidavits calling her out and supporting me. Karma's a bitch. But a woman scorned is scary shit

What are the laws against cultivation where your at?

Not the state or country....your exact location. Yes the laws differ some state to state. However there are ordinances that cities/counties will enforce. Plant count grow space yada yada yada.

If you find what your doing is a misdemeanor I wouldn't worry about it to much. The law has way bigger fish to fry than a 3rd party he said she said in a divorce case for a misdemeanor charge. If your in felony violation I'd cut and let things cool down. Either way you need to hold your friend accountable for all this. If it wasn't for your "friend" you'd be good. This is why I don't let anyone go around my farm friends, family or otherwise. Last but not least if she's a drug addict chances are she'd lie and say your doing much worse. She already mentioned pills and thats something the law don't fuck with. They'll definitely take interest in someone selling pills.

It's a toss up honestly....misdemeanor I'd let it roll.....felony, I'd ditch it and enjoy my freedom until things cool down.

Good luck

Man I can’t sleep. My wife wants em gone same as me right now but we both know we won’t be paying bills before too long. But idk that’s still better than time. And I can’t let her get in trouble.

But at the same time if they were gonna hit me up I highly doubt that they would be giving a heads up of evidence to my friend before hand. He won’t drop a dime, I know for a fact. It’s a civil court (divorce) not a criminal one so they would have to go hand it to a DA. And I am 100% positive there is no meta data on the pics. My dumbass took them.

Most of y’all are telling me to cut losses.
This sucks I was trying to move to WA after this grow (60 days) so my wife can get her medical card. Have to push that waaay back and find a way to get out of debit and try again in a year or two.

Talking to the wife again but I guess I’m out for a bit. I already miss it.

My friend is denying that the photo was even taken from his phone and filed a motion to have her drug tested pursuant to the custody hearing

Me and my wife talked we are wrapping up what we got and taking a break for a bit. Fuck it. Nerves are shot.
Having seen what it takes for the police to take a complaint like this seriously I'd say you're safe.

But nerves are what they are.

Go job hunting ASAP so you don't end up behind on your bills. That's stressful too.
