where do i stand??

So.... i have been trying to figure out where i stand legally, but have been getting conflicting opinions....

In Oct 13 i was planning to put together my possesion and growing renewal together to send in to HC. I decided not to because at that time things were all up i the air and my licenses didnt expire until the start of Fed 14. So i didnt renew.

Also at that time, i was living/growing in a rented house. In April 14 i moved to house i bought.

With everything that has happened legally for med mari here where do i stand legally? Am i covered by the injunction and legal to grow/posess or not?

You had to have your papers in order before the injunction date. If you allowed your ATP/PUPL to lapse, you are shit out of luck. I personally wouldn't worry about it if you're a legit med patient...and now you're in your own home, so no worries about all those mandatory minimum rules...not that I am advocating you break the law, but the other option to stay legal is to see your doc, and sign up with a lp. I would otherwise carry on as if you nothing had changed. The boogeyman is not coming and in fact he's about to be booted out of the PM's office!

if you moved I would be vary careful! if you get busted you have NO way to save face you will be charged! and your lic exp early imo your out. until the rulings

Don't take casual advice if you own your own home you are subject to civil forfeiture laws
If you want a real opinion spend a few hundred and get a legal opinion from a weed lawyer

Where you stand....is in line with the rest of us frustrated left outs waiting for a court case that isnt even done hearing arguments.

I'm with Bcbreeder in that you should get expert legal advice...a home is a big investment to lose. But that said, your chances of being convicted, much less facing forfeiture for personal medical use is very slim.

Yes its a slim chance, having survived one bust with a discharge, I ride with an mmpr script
Kinda like having insurance.
Stressful as all hell going through the system though,
Plus the cost of a cheap out in court (pleading guilty) is about 3600
The problem is that with the new laws you cannot get a discharge (a non conviction)
So you are looking at either jail time or a suspended sentence under the new regime.
Not nice having a conviction on file,
Its tough enough with a discharge, which is no longer available under the new rules.
Heck did anyone read about the 76 year old in the interior that got 6 month mandatory minimum
As a joint submission from defense and the crown for 150 small plants,
That's a few trays of clones...

Wasnt moving during the injunction, which would void the license, one of the things that was suppossed to be decided during the recent hearings?

Anyway...if i hadnt moved i would be good under the injunction right now though?

What i figured is that if i kept my old grow and posession licenses.... if i did grow under my minimums and get busted, i would have a very very strong argument against conviction...

I dont think they're going after guys like me ( my plant count is 25, but i have never grown more than 5)....

I dunno...

exactly, keep it status quo with your old license and keep it clean and tiddy.

I was told by K tousew? not to do it or you will be charged under the mandatory minimums and set exsample of. its a law, if you move your out! due to HC not keeping track of the site.
5 plants is under the minimum but do you need any bs in life? or just buy weed?

Good point...really dont need the bs.

But what i found is that the actually growing process is just as much medicine to me as the product of it...

Kirk Tousaw said the opposite to me several years ago when the mandatory minimums were first brought in. He claims if I have a proven medical need and there is no sales, then the mm wouldn't apply. I'm not sure I would want to be the guy to test that theory, though. It's your call, but I would personally grow 5 or less and be vewy,vewy quiet!

If you decided not to grow out of fear, you have successfully convinced yourself you dont have the right to a medication your doctor has approved you for. The charter of rights and freedoms protect this.

This man doesnt put his tail between his legs and act like everything is O.K.

Another very good point. I have never felt guilty about it at all.... and a guy has to stand up for himself and what he believes in...what is right...

And if i have to do that in court then so be it....
