Does anyone here at riu have legal expertise they can give me in an attempt to better discern how I can help him in this bullshit cultivation 10-12 plants in a medical/decriminalized state by a non mmj patient? Thankyou ahead of time.

Ok here goes........Have a close family friend whom was in a living situation where he and his girlfriend where sharing a trailer with another couple. after about two weeks of cohabitation the guy noticed that the other couple were stealing his medications so he confronted them. Things calmed down for a day or two until the dogs in the trailer got into a fight and the sheriffs office was called......While the sheriffs are there about the dogfight, the couple who stole the pain pills were obviously nervous and claimed there was cannabis growing in the trailer and it was the other couples grow not the pre-existing(for 1 yr1/2 prior to the new couple) and the sheriffs cite all four folks. Last week I drive him to court and he is THE ONLY ONE being charged! Not only was it not his trailer, he hadn't been there a month first of all, second of all the guy is a mental health client at a local mental health care outreach non profit, taking his meds and trying to stay stable with a decent quality of life. Cops found 10-12 cannabis plants, states attorney is trying to get a felony conviction in a mmj/decriminilazed personal use of a zip or less state on this guy. Not only that but the motherfuckers who did this never got charged for the fucken 45 perc 10 pain pills there junkie asses stole from him! My mind tells me theres a huge prosecutorial misconduct going on. I wanted to get him a fancy downtown lawyer but the dude wants 2500 retainer! That's unattainable atm. I'd appreciate anyone with similar experience or maybe (crossing my fingers) is a great lawyer or knows a great lawyer who can practice in new England!? Thankyou guys!

One is his current gf, the other two have multiple charges it turns out. Tis why I was concerned about shady shit being done, like he pointed out on the phone, this is some hick town, set 15 yrs back type situation. I am almost convinced there trying to steamroll him. He has been in trouble but never with this. a dwi I think and writing bad checks I believe when he was 18, yrs yrs yrs ago. The couple who resided in the trailer had previous convictions for drugs I guess and the wife in the relationship seems to be a master of manipulation/lying.

well, if the grow/plants weren't his, the only "evidence" against him will be the perjured testimony of the other three. If LE confiscated everything (plants, containers, lights, nutrients), then his prints/DNA won't be on any of it and theirs will, no? . Has he talked with a public defender yet and what was said? Sounds like it comes down to getting the $$$ together for an atty for him to get a fair shake. It sucks once you get into the wrong side of the legal system. Good Luck

THX, yeah kinda weird vibes coming from that whole damn situation. culpability shouldn't be based on how much money you can aquire for the court proceedings but it most def is imho from what little ive already ingested watching 2 hours of I think there called arraignments? highly annoyed. smh at how easily some folks can blow smoke up someones ass to avoid taking responsibility for there shit. Something tells me when that karma comes round its gonna be a doosy! Hard reminder to him/me/everyone in the family that there are folks in our society that will do just about anything to keep living the lifestyle's they feel are critical to there survival. No wonder folks end up missing these days. I have no trust/faith in the united states legal system, ive seen live how it rolls.

Having been through America's 'justice' system, I agree with your assessment; it does not operate in a manner which promotes fairness or acts as a deterrent against bad behavior. Those with money get treated with far more respect- which has nothing to go with justice.

The public defender is so overworked (that's IF you even get one) that their job boils down to pleading cases out. If you actually want a defense you'll need to spend the money and get a good lawyer.

FIRST mistake was moving in with junkies. Second mistake was calling the cops about anything that happens there.

2000 for a retainer for a really good lawyer here! I went with my bruve and saw 5 different law firms. Can anyone suggest a way to try to help him/us raise some bread for his defense? I apologize for being so naieve, but i dont wanna let my family get fucked over by the american fruad legal system.

Yeah, seems like gofundme is the only real hope at this point but probably wouldn't be sufficient. Create a fund then blast it on youtube, here and anywhere else you can.

So often I read sad stories like this. This thread made me come up with an idea. The idea is to create (I'm a software dev) a crowd sourced sort of "stoner insurance/legal defense fund" system specifically to for MJ related legal issues.

Anyway good luck with your efforts and like a guy above who pointed out your party in the situation shouldn't have prints on the grow shit but will have the real offender's. Take that to a public defender if that is the last resort.

1. go fund me is NOT GONNA WORK. They wont allow legal defense fund me pages. 2. Not only are there no prints to be had, the pre existing tenants are well known opiate abusers users, who'll do anything to support there habit i'm sure. I had to help him come up with a 2000.00 reatiner to get a lawyer that would "make this go away" true story! I'm trying, i just get nauseated when i think of all the SUPER wealthy who could donate 2000 in a heartbeat to the lawyers office, it's def no scam, especially when the fund goes directly to the lawyers office!

Did the guy talk to the cops and incriminate himself? Or perhaps the other parties made sworn statements to the effect that the plants were his? I don't think they would pursue the case unless they had something solid on him to tie him to the plants.

No he didnt speak to the cops about anything. He HAD to call his doctors office and report his medications stolen, hence there lies to try and pin there grow on him. He's a schizophrenic mental health patient guys. lol he has no clue whats really going on.

I'm gonna loook for a local norml branch explain the situation and see if i can get some help advocating for a menaally ill patient being exploited by the states attorney/in grand isle county
 
Go get legal advice from a lawyer who you are paying for their services, and don't post shit on message boards about your case because the court can subpeona your computer and find your history even if you've deleted it.

And find a good lawyer. Look them up online and read reviews of them if any are available. You get what you pay for when it comes to attorneys. Cheaper ones will take your money and ignore you, won't return your calls, and won't take your case seriously. More expensive ones will have at least two people working on your case.

Again, don't bring up details about your case online, here or on facebook, or any other site. Don't text anything about your case either.
