Your statement is not illuminating. We know what section 8 says. Your assertion is that if you make the prongs, and the prosecutor cannot refute them, the defense is deemed valid.

Ranks right up there in value with 'If I pick the right numbers, I will win the lottery'. Also a true statement. Apparently you don't see that. Making a generic statement like that says nothing. You have to pick the right numbers and satisfy the prongs. Good luck trying to do that with your document.

I specifically challenged you to present the actual and specific words of a lawyer that reviewed your 'document' and was willing to go on record to say it would protect an unregistered caregiver, defeating the challenges of the prosecutor. You present it as a valid strategy, show me an attorney that will go on record saying it stands a reasonable chance of working in court.

The links posted above are straight from an office that has gone on record with what the law provides. They are all the documents necessary to satisfy my claims. Lawyers do not make claims whether or not courtroom claims have or have not guarantees, and neither do I.

Your challenge has nothing to do with the substance of the original thesis and only distracts from it. For that reason, it is not worth my time.

"Primary caregiver" or "caregiver" means a person who is at least 21 years old and who has agreed to assist with a patient's medical use of marihuana and who has not been convicted of any felony within the past 10 years and has never been convicted of a felony involving illegal drugs or a felony that is an assaultive crime as defined in section 9a of chapter X of the code of criminal procedure, 1927 PA 175, MCL 770.9a.

__A recommendation for use of marijuana for medical purposes (copy attached) was obtained from Dr._____________________________,
a physician authorized under Part 170 of the public health code, 1978 PA 368, MCL 333.17001 to 333.17084, or an osteopathic physician under Part 175 of the public health code, 1978 PA 368, MCL 333.17501 to 333.17556, license I.D. number____________________, and dated___________________________, stating that in the physician's professional opinion, and after having completed a full assessment of the patient's medical history and current medical condition made in the course of a bona fide physician-patient relationship, that I am likely to receive therapeutic or palliative benefit from the medical use of marihuana to treat or alleviate the debilitating medical condition or symptoms associated with the debilitating medical condition.

All parties to this agreement should keep copies of this, the required medical documentation, and identification of the principals for their files.

This will not prevent arrest and due process, but will, as long as a court abides by the law, help prevent conviction and require the charges to be dismissed in accordance with Sec. 8 as long as the evidence shows both parties to be in conformance.
All that remains is to prove an amount necessary to ensure an uninterrupted supply.

I am moving a sec. 8 case forward as we speak.

There are only three numbers here, and they are not random. There is no guesswork involved. That is apparently beyond you.
