So I was convinced us Az cardholders are allowed to have guns now a friend of mine is saying he read somewhere we lose our gun rights when we get our cards through azdhs. Has anybody had any experience with the law trying to say anything about your guns now that you got your card?

he is full of shit. the ATF issued a MEMO "MEMO" to gunstore owners saying marijuana is still a drug. and on the form you sign when you buy a gun from the store it ask you if you are addicted to or use illegal drugs. no you are not you have a medical card so its not illegal for you. you cant loose any rights for participating in the mmj program.

if you walk into a gun store and wave your green card around the owner may decide not to sell you a gun. and that memo was only to gun store owners. and it was just a memo not law or anything. no one has anyway of knowing your a patient unless you tell them. and you can always buy private party out here.
a friend of mine got pulled over withhis gun and bud didnt have his card on him got arressted, then went back with his lawyer and cards and got his gun back

so tired of hearing this scare tactic. the bullies (fuckers in charge), started this rumor due to the many gun enthusiasts and lax gun laws here. they thought they could scare a lot of people into not getting a green card thus making the program a failure. thugs and bullies are all that run this state.

Naw I heard about this It's flat out illegal to own guns and have a mmj card.
I wouldn't want a gun anyway, adds 10+ years to a felony. Or it it elevates any crime to a felony as well I'm a lil fuzzy on the details.

it's not illegal to have both, the mmj and the gun, as long as you comply with all related state laws. but if you get caught with any mj crime that the mmj card doesn't cover, like if u have too many plants or too much bud, then you can expect to be seriously fucked just the same as if you didn't have the card at all

I think the federal government may have a problem with you lying on a federal form about your "legal" weed.
Also in the end you may be surprised who has access to your info. The police have access the mmj database of patients here in Colorado.
They can get limited info on a patient with a card.
This shit is changing every day and if you're giving info on a topic like this you should at least get it right, bad advice here could put someone behind bars.

The form asks if you are "addicted" - that is awfully subjective. It's our right to carry - a personal healthcare decision has nothing to do with suspending our constitutional rights.

While i agree 10000% in a Constitutional sense.... the way i think of it is this:
I NEVER carry weed or my weed card outside my house, because i always carry a sidearm. When i carry my side arm, i dont even think about weed....its like a game of make believe. My weed and my guns paths NEVER cross.

As they say in the CIA, its only illegal if you get caught, so i try to work by those rules.

I have my CWP and my MMJ card in 2 states.....whats the problem??? I carry all the time even when im in our mmj stores....digging my LC9:)

I just got one of those for my lady!!! i want one for me now too, such a nice pistol.
I have a Sr9C and LOOOOOOVE it. Sold my glock b/c i NEVER carried it anymore once i got the rugers

Very interesting no one else said this.

What I understand from the site is that while your AZ MMJ card is active you are not permitted to purchase firearms from a federally licensed dealer.
(That would not include gifts and expo's; etc)

You are still allowed to own your current weapons.

In regarding to carrying cannabis and a weapon; (based off my own experience only) You can get away with it as long as you aren't medicated.

If I can walk into a licensed dealer and they run a background check and I pass, I am not going to tell them I have mmj cards. If I should have them, then I should fail my background check.

If you go around telling ANYONE AT ALL That you have a mmj card you are dummy. Why on earth would anyone need to know what your medical conditions are, if you have herpies you dont tell everyone about your vitrox script, or if you have a nasty rash you dont tell anyone about that either....so why bring up a weed card.


KEEP YOUR MOUTHS SHUT AT ALL TIMES!!!!

SWIM just bought a new glock 27 pssed the background check and walked out in about 20 minutes, has a weed card and is a wicked alcoholic....just act cool and you will be cool.

Your friend has a good point. When filling out the form to purchase a firearm it asks if you are addicted to or habitually use a controlled substance. If you answer yes to that question you are disqualified from purchasing a firearm at a federal level. That however does not preclude preexisting gun owners from obtaining an mmj card.

So, in short. If you have not received your AZ mmj card and would like to own firearms, I suggest you wait, get all the guns you want first, then apply for your AZ mmj card.

The law is black and white. Not shades of grey.

Funny AMMA newsletter for October is all about this.

It basically says if you purchase or own a gun while you are an MMJ patient you could be subject to federal prosecution. Due to the little box you check that asks if you use Marijuana, if you check no then your looking at perjury.
