Marijuana Legalization Progress: Members of Congress Call on President Obama to Use His Authority to Reclassify Marijuana

February 13th, 2014 / Corona, CA / ACCESSWIRE / Extreme Biodiesel, Inc. (XTRM) today announced through its wholly owned subsidiary XTRM Cannabis Ventures that U.S. President Barack Obama has been asked by members of Congress to use his authority to reclassify marijuana stating in a letter that marijuana’s current status “makes no sense”.

Eighteen Members of Congress joined together today in calling on President Obama to use his authority to reclassify marijuana from its current position as a dangerous drug, alongside heroin and LSD, with no medical value.

A letter, signed and sent by federal legislators Wednesday February 12th, 2014 states that marijuana’s current status “makes no sense,” and requests that President Obama “instruct Attorney General Holder to delist or classify marijuana in a more appropriate way.”

“
Classifying marijuana as Schedule I at the federal level perpetuates an unjust and irrational system,” read the Congressional letter. “Schedule I recognizes no medical use, disregarding both medical evidence and the laws of nearly half of the states that have legalized medical marijuana.” In a separate statement, the letter’s lead author Congressman Earl Blumenauer (D-OR) said that reclassifying marijuana “is a step the administration can take to start to rationalize federal marijuana policy to bring it in line with the advances that are happening in the states.”

In addition to Representative Blumenauer, the Congressional letter sent to President Obama Wednesday was co-signed by Representatives Steve Cohen (D-TN), Sam Farr (D-CA), Raúl M. Grijalva (D-AZ), Mike Honda (D-CA), Jared Huffman (D-CA), Barbara Lee (D-CA), Zoe Lofgren (D-CA), Alan Lowenthal (D-CA), James McGovern (D-MA), James Moran (D-VA), Beto O’Rourke (D-TX), Jared Polis (D-CO), Mike Quigley (D-IL), Dana Rohrabacher (R-CA), Jan Schakowsky (D-IL), Eric Swalwell (D-CA), and Peter Welch (D-VT).

The CSA gives authority for rescheduling controlled substances to Congress, but it also grants executive branch authority to the U.S. Attorney General and the DEA. “President Obama just told the nation during his State of the Union address that because Congress has been unable to act, he would take executive action where he could on behalf of helping the American people,” said Steph Sherer, Executive Director of Americans for Safe Access (ASA), the country’s largest medical marijuana advocacy group. “The president has the authority to reclassify marijuana and could exercise that authority at any time.”

This Congressional letter comes less than two weeks after President Obama told The New Yorker magazine that marijuana was less dangerous than alcohol.
XTRM President Joesph Spadafore stated “We are positioning XTRM Cannabis Ventures to be ahead of the curve. As legalization on a federal level occurs we plan on being able to capitalize on it sooner rather than later. This is a rapidly going sector and we are very excited to be part of it.”

He has no legal authority to unilaterally change the law by himself.
Ill grant you he has been doing it. But it is illegal. Not that laws have ever stopped him from doing what he wants.
So for those of you who like this dictatorial approach to government remember. If you like the way this dictator operates.you might not like the way the next dictator operates as he is setting what is called precedence for a future presidents dictatorial powers.

j The federal government is ready to let farmers grow cannabis — at least the kind that can't get people high.
Hemp — marijuana’s nonintoxicating cousin that's used to make everything from clothing to cooking oil — could soon be cultivated in 10 states under a federal farm bill passed by the U.S. Senate on Tuesday and sent to President Barack Obama for his expected signature.
The bill would allow the establishment of pilot growing programs.
With marijuana laws loosening nationwide, lawmakers who support industrial hemp cultivation saw an opening and pushed through a provision that allows colleges and state agencies to grow and conduct research on the crop in the nine states where it is legal.
Kentucky is among them, and Sen. Mitch McConnell, R-Ky., was a major backer of the provision.
The plant's return to legitimacy could clear the way for U.S. farmers to compete in an industry currently dominated by China. Even though it hasn't been grown in the United States for decades, the country is one of the fastest-growing hemp markets.
In 2011, the U.S. imported $11.5 million worth of legal hemp products, up from $1.4 million in 2000. Most of that growth was seen in hemp seed and hemp oil, which finds its way into granola bars and other products.

Unless congress funds the executive order there null and void. He can't do an executive order on this but he can pressure the DEA since he is over them administratively and since the executive branch delegated the power to the DEA.

Executive orders and presidential directives are solely used for the executive branch of government. They are supposed to be used for directing the executive branch.Yes the DEA is under the presidents executive branch. However the president cannot legally change a law.PERIOD..Some executive orders to not need funding, such as directing his attorney general on enforcing laws,On how to enforce those laws or not to enforce the laws.(also illegal)He has no legal authority to change any law anyway he wants to.
It is very illegal but no one can stop him as he is protected by the US senate and the US attorney generals office (office of Eric Holder)also run amok and lawless.
If this were any president but Obama he would have been impeached, removed and thrown in prison for a list of crimes.Starting with over three hundred counts of murder and acts of terrorism against Mexico.

the Government has no legs to stand on....they say marijuana is listed as a schedule1 drug because it has no medical value.....then they get a U.S. patent# 6630507 on the medical properties of marijuana

The patent held by the U.S. Dept. of Health 2002-2021 makes the sch 1 listing void...IMO

In politics....don't let the right hand know.... what the left hand is doing....do what we say....not what we do:)

You do know past presidents have used the executive order more than he has ? I think that ship has sailed but I agree with lowrider, I think he would wait to leave office.

Yes other presidents have used executive orders. But none have ever used executive orders to change laws.
Even liberals who have a brain,KNOW that even if they like what the president is doing unilaterally changing laws that it is illegal,They also KNOW the next president might not be a democrat and abuse those executive orders anyway he or she sees fit,
They know this is a dangerous precedent.Remember Adolph Hitler was elected.
When this kind of precedent is set smart people know it opens the door wide open for anyone to abuse especially if it is not checked.
Some of the stink foot hippys might be happy hes doing this,But i see it as a huge danger,so do many others.I do not want any president to have dictatorial authority to change and make up laws as he goes along. No matter how much i might agree,Like for example marijauana is a plant..not a drug in my book,So id tend to agree with this particular decision.
THATS NOT THE ISSUE.The issue is the act of him doing so is illegal,The other issue is the next prezzie of the united steezy will be able to do this without much being said.
Like for example banning marijuana all together and sending the goons after ALL legal states throwing people in jail every place,Not a fucking thing will be able to be said about it either.
The same people who are saying.cool right now will be saying WTF just happened latter,.And they will say.he cant legally do that..well..Yea..he will be able to legally do it.
They will tell you to just sit down and shut the fuck up..the other guy did it.,
Just like the senate changed the rules of presidential appointments only requiring a simple majority for confirmation,
How well do you think this will go over when the other side of the isle does it when they are in power?
I do not like the idea of any president having that much power and authority.I do not like either side being a libertarian.
I think they should all be made to wear like NASCAR suits and anyone who gives them money to get elected they MUST wear that companys patch on their jacket. That way you know who sponser's them and who they work for.It sure as hell isnt US,.
