Plant Limit

Thought I'd share the word. Got word from the doc that plant limits were removed and that people were not being prosecuted for number of plants albeing for personal use. Anybody else hear anything or should I be trying to find out where my doc gets his supply?

Dont take legal advice from your doc unless you trust him like that.
My doc was asked to stop with legal advice because it was not accurate.

bullshit burden of proof to exceed state limits is on u cops will fuck with u rip ur crop take u to jail file charges (which will later be rejected, probably) and when its all said and done u r fucked and have no meds

There's county regulations, average is 6 plants per patient. If you can prove you need more per patient you can get allowances from the courts. There's also 99 plant and 75 plant care giver cards. But you have to be an actual care giver, taking full care of your patients. In other areas like Humboldt and mendo , patients are allowed to have a 100 sq ft per patient and not plant numbers. If you are legal and local and state police or sherriffs take your plants. Make sure to press charges against them and file law suits . You will win. Most of the sherriff raids are illegal. Also if the law is on your property. They are trespassing. You have every legal right to defend your home. Male sure its all documented. Film the police and everything. Even they try to stop you from filming. Its your constitutional right. Freedom of press.
 
I would go by what your county will allow. My card says 60 but that doesnt fly 35 miles from me. CHECK WITH YOUR POWERS THAT BE. not the doctor If he is like dr. brown in fresno he may be more into your 200.00 than your court date. Any doctor that charges more for a 99 card seems shady to me. If you need that much you need that much. Why does it cost more for the doctor to say so-------mike

He's talking about the amendment to 215. read up on it in Cal Norml. Each county will have it's own rules on what you can or can't do. Which they should all be sued if it goes against what the state has put in place. Paying a doc for a higher plant count card is a scam in it's self and does not prevent you from prosecution either.

Everything you need to know about medical herb is in the California State attorney general.

Six plants is your limit for 1 person.
They say 8 dried ounces but they said putting a restriction is unconstitutional in people Vs Kelly.
So the limit is 6 mature or 12 immature.
That's what I would stick to.

I would ignore the 99 plant rule.
You would need to be a non profit corporation to do that many.
You would also need 16 people or more in your collective to legally do that many and your city needs to allow that many San Francisco being one of those city's.

The closer you follow the California State attorney general guidelines the better your off not being prosecuted.

They are trying to shut down outside growing. Dispensaries are getting run out of town and the law is again running city and county government.
Mean while the pot smokers are rising up and fighting. There are some towns that aren't but that's because the people there don't speak English
and the officials are taking advantage of that. But they always pick on the one's that won't stick up for themselves.
They got a surprise when the stoners stood up and said fuck you.

In Fresno first they banned outdoor in a few places then they banned outdoor in the whole county then they banned growing indoor also. I would not be surprised if this will be a model for others. Mind that they did all this in more then a few years but they have successfully outlawed growing in Fresno and people are facing finds of $1,000 per plant and an additional $100 a day if you chose to wait and not kill your plant immediately. Someone was charged $33,000 for growing 33 plants indoor for personal use. They take your property if you can not pay.

From my understanding, only your Dr. can recommend how many plants are right for your particular condition. Your local police may arrest you for more than the 6 plant limit (calif), as long as your Dr. will testify that you did indeed need more than 6 you should be OK, kinda sucks to go through such hassles....

AMENDMENTS: Yes. Senate Bill 420, which was signed into law in October 2003 and took effect on January 1, 2004, imposes statewide guidelines outlining how much medicinal marijuana patients may grow and possess. Under the guidelines, qualified patients and/or their primary caregivers may possess no more than eight ounces of dried marijuana and/or six mature (or 12 immature) marijuana plants. However, S.B. 420 allows patients to possess larger amounts of marijuana when such quantities are recommended by a physician. The legislation also allows counties and municipalities to approve and/or maintain local ordinances permitting patients to possess larger quantities of medicinal pot than allowed under the new state guidelines.

There is a difference between legal and what you can get away with. Legally you can have more than 6/12 and 8oz... but if the cop chooses to say you are over the limit, it is up to you to prove it is medically necessary in court. So yes, 99 is legal, as long as you're willing to go through defending it in court if you ever have legal issues. 6/12 and 8z is what keeps you from having to deal with that in court (unless you are dealing with a dick cop, which fyi, they can still arrest you for it regardless it may just get tossed later once you get it to a judge).
