No lawsuit can possibly change the Law portion of the AMMA. The *Rules* can be changed, but not the letter of the law. The 25 mile exclusion zone is a key part of the law. We needed a ballot initiative on the 2012 general election, which I don't think anyone even tried to do. As a result, personal cultivation is over for AZ in 2013. I'm only unhappy about that because I cannot afford to relocate to Colorado.

Well, sounds like its time to use the 2nd way to skin the cat: if the feds won't hear the case, because the outcome is a foregone conclusion (25 mile clause is a gross violation of equal protection) due to "its illegal federally anyway" then we use the feds: The dispensaries in the metro area will have thousands of customers, and be big money targets for the DEA. Report them. Let the DEA shut them down. The DEA loves to SEIZE property. We could at least get the dispensary owners on our side this way.
I have tried not to be evil enough to suggest it, but does anyone actually have this plan? Insist on DEA enforcement against dispensaries? Does not seem like a good way to go.

While a lot of Humbles rules can be challenged because they are outside the law we voted on. In order to change the law as voted by the people would require another vote by the people.
You are one of the few posters who seems to understand the distinction between the AMMA *law* and the AZDHS *rules*. Mostly, people have been complacent about the 25 mile rule. I suspect that most are willing to have illegal grow rooms anyway, many don't understand what the rule means in the first place, some are delusional and think their grow rooms get them a gig as a contractor growing for a dispensary, and some just don't care. We needed a new ballot initiative in 2012.

Absolutely. I have no reservations reporting people who are extorting money out of people for a plant that they know full-well that their customers could just grow at home, if not for an unconstitutional law.
 
Anybody being locked up for weed is ridiculous and unnecessary. Anybody wishing for somebody else to be locked up so you can grow in your closet should be locked up too. There is other ways to go about it than wishing misfortune on others. And snitching is a no no anyways.

Section 13. No law shall be enacted granting to any citizen, class of citizens, or corporation other than municipal, privileges or immunities which, upon the same terms, shall not equally belong to all citizens or corporations.

Uhh.. perhaps this would apply. They granted a privilage/immunity to people outside the 25 mile radius.

The "25 Mile Rule" is unable to support the purpose for which it was intended. The unconstitutional portion of AMMA is unenforceable.
Can you be arrested? Yes... A judge determines the outcome through due process not a police officer booking one into jail. This goes to another subject... Don't ever talk to the Police - everything said will not be used for your case but "Against You".

Not to dredge up an old thread but what, if anything, is being done to get a ballot out there for next year? I'm new to AZ and MMJ and have started to investigate the issue being a prior certified cultivator in another state. I found the original lawsuit that sparked this thread and the outcome makes sense. You can't get a judge to support something that is by definition illegal on a federal law even when it conflicts with mens rea and precedence exists favoring the plaintiff(not gonna past a bunch of cases here but they exist if you google).

We really need to get the AZ voters educated and get them behind this, what is being done and what can we do now? Has anyone even talked about proposing a bill? Which state representatives would be willing to hear this sort of bill out?

Hey Fellow patients! A few patients I have are due for a renewal here soon and was wondering where I can find the map of the opened dislensaries and weather They fall into the 25 mile radius. I thought I had it bookmarked but apparently not haha +rep for any help

my card expires 4/20 and I'm hoping for authorization, woohoo looks like i might just be east enough to make it, anyone know of a good place to get cheap quick eval/renewal?
 
I am a medical patient as well, my card expires 9/15. Is there anything I can do to help you? I have excellent medical records, showing a spot in my lung that kept getting larger until I got my card and started growing and it disappeared. Also including 16 hospital stays (5 days Minimum) in the two years prior to getting my card and ZERO hospital stays in the one and a half years since I got my card :)

Congrats on finding a med that works for you and improves your health and well being. You and so many others need to have your stories shared so the good that cannabis offers can be known. This will hopefully spark a fire that will lead to viable research. CBS 5 needs to report a positive story like yours instead of the slanderous "investigative" story they did recently.

Fuck the 25 mile rule! That's all...

Pardon me if I haven't read the entire thread through...I'm not in a 25 mile proximity yet but very close...when looking at the dispensary map I noticed that one closest to me advertises "delivery only". Do you think they are counted as a 25 mile impingement to cultivation rights? I can order pizza delivered to my house but no law is stupid enough to stop me from making my own.
