Natura = big American money buying their way into the game. With such a monster facility their only hope to succeed, is to export. They are setting up shop here in Canada in anticipation of the future legal markets in USA. Purely greed driven. Companies like this give compassionate growers a bad name, who truly want to help others and spread the word of this wonderful plant. Not to be the next Marboro. Just wait, I can see them suing other LP's if they claim to have Charllote, exclusive producer and all. That's crap, to keep a monopoly on a strain is bad ju-ju.

Unless cw is gmo then they can't claim exclusive anything. You can't own the Appel or the Orange. Or have exclusive rights to grow them. Even though it was selectively grown over and over if a clone gets into the publics hands it's free game. Anyone know if it's can be grown from seed or only from cloning?

That's not correct. You can protect plant cultivars, but it falls under plant breeder's rights rather than patent law. When companies patent GMOs, I believe they are patenting the gene so it falls under more traditional patent regulations. Now that the industry is legal companies will start protecting cultivars under this system. I doubt CW is protected yet, but it is only a matter of time.

If you look to the rose industry, every time people propagate protected cultivars, they pay a royalty to the developer. This will apply to pot, and given the requirements for everything to be tracked (in theory), they will be in a better position to enforce it than in most industries.

Thanks for posting that. Let's hope this never happens to the greatest plant known to man. If I'm not mistaken how would they be able to watch everyone. For example there are hundreds of breeders in Amsterdam selling all kinds of different genetics. If by chance someone in Canada did the (PBR) how would that stop someone from another country form growing that specific plant and selling the seeds? Just curious. Are these laws internationally regulated?

One thing I will mention though, is that in order to protect a cultivar you must demonstrate how it is different. So, anything that is currently out there could not be protected in this manner (unless they find loopholes), just as you could not protect Macintosh apples. I assume this is a large part of the reason Bedrocan is using their own branded names. They will likely protect these based on detailed descriptions and chemical profiles.

There are international agreements surrounding this for member countries (Holland and Canada would both be included). Companies often receive Canadian distribution rights for foreign cultivars, so we adhere to it (at least to some degree).

Often, if you receive material from someone they would ask you to sign a material transfer agreement that outlines your permitted use. This may allow you to propagate it, it may include royalties, etc. This is a contract, so it is legally binding.

One of the catches here is that most pot strains to not breed true, so protecting the seed would be a challenge. However, you can protect individual clones, so this is what I would expect to happen first. I really doubt any of the current breeders have protected their cultivars due to the legality issues, but it is coming.

As for enforcement, that is difficult (as with many patents). You need to show what distinguishes yours from the others to protect it. Then if you see someone growing it you would have to challenge them and prove it is yours I guess. I dont think this is too important for the little guys so much, but if an MMPR producer started selling another's protected material it could be challenged quite easily and there may be enough money involved for them to do so.

And it will be crap like this that will allow the BM to continue to thrive, albeit in a different area of the same business....money. I would really be curious to see how anyone is going to stop people from growing a weed. If I buy seeds and save them, who is going to know? I will just keep on collecting different seeds and not worry about it.

good luck with successful prosecution. if 1 clone of cw is in private hands it's gone forever to be cross breed with many other strains.
