'Under the new law, possession of 25 or more plants (formerly 300 plants) is prima facie evidence of intent to sell or distribute, and is a second degree felony

Florida laws not any different than any other state except maybe Cali and Hawaii. If you aren't gonna grew more than 25 plants you got nothing to worry about. 4-8 plants and its a fine of $1,500.

I am an activist with NORML in Florida. We have worked very hard to reduce mandatory sentences, decriminalize possession and allow personal growing. We work especially hard to prevent dis-information particularly from people not familiar with our state.

This is not a Florida against California battle. We smokers and growers are ALL ON THE SAME SIDE REMEMBER?

It was only 5 years ago that growing any amount of marijuana was a felony and then anything over 300 plants was mandatory 5 years. Now,after much hard work, it has been reduced so that anything up to 25 plants is simple possession (non-felony).

On a forum like this I really can't understand why you would hate on Florida and warn smokers to leave the state if they hadn't already.

Listen, smoking pot is really a mellow, peaceful thing man. Its not really a trailer court redneck scene. Maybe you have lost your way and ended up on this forum by mistake. We be chiilin here and really don't need your buzzkill....peace

im sorry but you are 100% dead wrong. If you work with norml you really are a complete moron, go read the site dummy. Under 25 is still felony. I mean the information is listed in plain language on "YOUR" own organizations website. I mean in this post you talk about not spreading misinformation and look your spreading misinformation.

Under 25 3rd degree felony. Punishable by 5 years in prison

Over 25 or 25lb cultivation mms 3rs up to 15.

I know some peeps that live in FL, they got busted, 17 grow houses, hundreds of plants betwen the homes, cash, guns. The bust was called operation family tree, there were about 18 people involved. Nobody did any time and they all had public defenders. Two that got busted went right back to it after they got out and they got busted AGAIN, I'm pretty sure they will be doing some time now. The majority of those people are now movin to CO to do the same thing.

I know this is an old thread, but I wanted to see if anyone has noticed, NORML updated their website on Florida laws even though they haven't changed.

It now specifies that for the mandatory sentence it has to be over 25 lbs or 300 plants. Not over 25 plants. Under 25 plants is a felony 3rd degree (but it is in MOST states) and 25-300 plants is a felony 2nd degree. No mandatory minimum, many get off with no jail time.

I don't know why everyone here rags on Florida for being so "harsh". I'm disappointed no medical legislation has been introduced there yet, but besides that the laws aren't nearly as harsh as some states. Say for example, Illionois, where more than 5 plants is a mandatory minimum sentence of 1 year.

...or just about all of the "bible belt" where they'll lock you up and through away the key. Seriously, look at them, it blows my mind to see life listed as a maximum penalty for a plant..
 
My wife & I are both certified by the state of CA to use Cannabis as medicine, but we live in Florida....we both have chronic pain from unrelated accidents that we both deal with pain in different body parts...In 2004, I went through an explosion related "Hurricane Jeanne", I have had two bone transplants & upper extremity fused to where I can never rotate my extremity which in itself gives unbarely pain I also have pain in my cervical spine all the way to my lumbar spine actually my whole right side is effected. As well as giving me a seizure disorder I am so messed up I can't hold more than 10 lbs in right hand...my wife when she was younger broke her lower extremity which also fused. She is actually lopsided b/c she is 1/2" shorter on her right side than she is on her left. Her Lumbar spine & tailbone has bulged and narrowing to her spinal cord...we have chosen not to take the oxycodone narcotics that our Drs...wanted us to take for pain.Instead, we have chosen to self medicate ourselves w/medical cannabis when we can. The state laws chose not to legalize medical cannabis at this time. We have contacted the Norml organization in CA & in Florida. The Florida Norml Organization wants me to go public & be their new guinea pig in trying to get medical Cannabis legalized in FL at my expense. We have chosen not to do so at this time due to we have a lot to lose including our children & most of all our freedom...which everybody knows that if I get arrested my wife will too & then she will never let me live it down Literately!!! so for now until we can vote to have Medical Cannabis passed. We will & continue to be closet users....(We want the LAWS changed to Legalize it and consider it as medicine) Trust me & my wife it really does work for pain & other alliments!!! So C'mon fellow Floridians vote YES to Medical Cannabis Sincerely, Mr. & Mrs. Opie Taylor

you are correct about the laws in FL of possession and growing in our state; but we have connected the Fl Norml organization which is trying to get the Medical Cannabis legalized for the state of Florida is a good organization... but if you are growing illegally then you are not helping the problem of people that really need or use Medical Cannabis as medicine. There are a lot of people in the United States that have chronic pain and some are addicted to the prescription pain meds that are prescribed by 1,000's daily. We need to have an alternative for pain relief other than what these pain management physicians are providing patients. These patients are good people and just seeking relief from having chronic pain and other medical issues are being turned into addicts. I truly don't know how these physicians that are prescribing such dangerous medication can sleep at night. They truly know that 1 prescription is all it takes and then the patient are not only fighting their alliments but are also teetering of becoming a junky from the pain meds they are being provided just to be pain free. Most pain management offices will not accept a patient if they test positive for cannabis. Medical Cannabis is a hell of a lot safer than some of the pain meds out there...I truly hope we can get Medical Cannabis legalized so that Florida is no longer known as "The Pill Mill State", I know of so many people that have died from their pain meds being prescribed...but you don't hear of people dying from Cannabis...I do know of people that use Cannabis as medicine that has families, holds successful jobs, and are good standing citizens! So don't be so hard on trystick which is an activist for Fl Norml Organization...because after all its just a plant-just like a tomato or cucumbers that you can grow in your own gardens. You have understand I want to live a better quality of life than having to rely on a "pill in a bottle", by a doctor that cares more about the money in his pocket from prescribing these nasty meds than he does the welfare of his patients.

i live in central Florida and i know 3 people who have died in the last 2 years from roxys and have never herd in my entire life of someone just dying form marijuana. my older sister used to shoot them up and had to have surgery on her liver bc of pills and she was prescribed them because of leg pain from a car accident and she still isn't off of them. its just ridiculous 18 year old kids can just go to a doctor in Florida and say oh my back hurts and they get 120 roxys and like 150 xanax but i cant smoke a joint on my fucking back pourch! sorry guys its just so dumb i would love to move but my wife's whole family is here

So what you're saying is that Florida does not make exemptions for MMJ??
