Laws?

Hey guys,

Im from Canada. I just wanted to know what the rules and laws are regarding the transfer of cannabis from a grower to a buyer? Can a rec buyer go to a grower directly? What about medical? Only through a dispensary?

Im pretty sure places with Rec licences are able to buy from growers that have a commercial cultivation and wholesale licences. Otherwise I was originally under the impression that all medical ops were supposed to strictly grow their own product... but ive seen places have bud from other dispensaries, so im not sure what the deal there is.

As a customer coming into colorado with an out of state ID, you are only able to buy from retail dispensary (not the growers)

As a colorado mmj patient, you are able to obtain from a dispensary, or a designated caregiver.

Depending on what state you live in, some have a compassionate use act. I.e California which allows you to sign
up as a caregiver for patients to grow which shows law enforcement that you are a caregiver and not just some clown trying to grow 300 plants because some patient said you could use there rec. this makes you immune to law enforcement as long as you are with in the guide lines of the number of plants you are growing for how ever many patients you are care giving for. i dont know if this is the same for other states.

no I wouldnt think you would be able to do a one time buy... also you have to have a CO mmj card, doesnt matter if youre a canadian mmj patient.

The only legal person to person distribution is from a caregiver to a patient. The mmed has a form that must be filled out by the patient in order to designate the person as a caregiver. Also under law caregivers can only charge for cost of production and nothing else. Per law they must also take a significant interest in the well being of the patient and provide non cannabis caregiving services such as meal preparation, shopping, transportation, and so on.

As far as rec goes, you can give an adult up to one ounce with no remuneration. Selling it or bartering is still illegal person to person and must be bought from a rec store.
