I need a lawyer

So i asked for 137k in the end, last friday. This friday, yesterday, they countered 42.5k, saying reinstatement is off the table. Hahahahahahah
42.5k just accounts for lost wages up to now.

But they said they would entertain a counter to their counter....

Im tempted to say split the dif in the middle at 95k ish and call it done. But then i get taxed to hell on that. 30% gone. Unless... everything over the 42.5k is classified as punitive and/or personal injury damages... which would be hard to justify to CRA it they came calling.

But then an American corp gets away with breaking canadian law and will continue to do so until somebody puts up a fight...

So my gut instinct is to just say no to them.

So go with my gut or with temptation... fuck me?????
Counter offer them 160k, just for insulting you

Well... i didnt budge. Just repeated that i need 100k net to walk away. Its a bargain. By the time this gets to the HRC itll cost them close to triple that.

Anyway... see what they say. If i dont update soon then ya all know we have gone to war and next update wont come until HRC hears us out...

My guess is their attorneys know exactly what they’re doing. They will try to show their willingness to make a deal at all costs. This is exactly what the courts want to see...settlement by the parties. Whoever try’s the hardest to settle, will usually gain the judges favour if it gets before the bench.
True. But thowing peanuts at a guy isnt going to win any favours from anybody.

43.5k is what they owe me in back pay right now. So... they didnt offer a settlement. Not really...

you have to go at them with one piece at a time.]
when they down play one part .........You ADD more info as to why it should be more....
Dont give them all the pieces of your deal.
When they say "here take this"
You say...but then there's this and this as well.....and let them offer again...
and so on...
Let them offer more with out you asking if you have things to back you up still.
..just give them reasons to offer more;;

Totally reasonable counter on your part. You guys are not that far apart by all accounts. Anything north of $75k and I’d bite.

When are you due to see HRC?
In december i was told 12 to 18 months.
My lawyer said that is just the investigation hearing. A resolve tribunal follows that... anywhere from 6 months to 2 years after that hearing.

Alberta is sadly lacking in manpower in Both the courts and HRC...overwhelmed...

Take your time it will only mean money. Ive sued 3 times and have been sued once. Time was always my best friend.

Are you paying lawyer out of pocket or on settlement?

Out of pocket.
They wanted 25% off the top for contingency.

I didnt even consult my lawyer on that. He wouldve charged me prolly 300 bucks to tell me to tell them no way... lol

I wonder if you could add stress to your case....no wages, unlawful dismissal, shady dealings...no idea but it may be another bullet in the chamber...I always like extra ammo.

I asked HR for my benefits package booklet... since i am still an employee, after all, and getting benefits still. And asked for the short/long term disability forms... let em know subtley that im settling in for the long haul...

Make doc appts tomorrow...

Oh yeah!! Maybi ask are you using short/long due to this? I wonder what the insurance company DR will say about MMJ..would be even funnier if your employer got a little report :)

They sweated me. I didnt budge. I even got pretty fn snarly last week when i said again 100k net of ALL taxes and that anything less would garuntee a fight.

Today my soon to be ex regional manager called to say that while he could not tell me the number they came up with (because top dog has signed off on it yet) he could say that i will be happy with it when he emails me the paperwork, probably Thursday.
