So last night I was kickin' it with a few buddies they were all drinking and I took like 2 shots and turned down other alcohol because I was the driver..
So I was taking one of my friends home when we get pulled over (for my muffler)
He takes my license and registration and comes back to the car.
He then comes back and says.. your license is restricted, your not supposed to be driving after 11. (I had totally forgotten that it was restricted) He was like.. it smells like booze in the car is there any alcohol or marijuana in the car? And I said yes officer, heres all the weed in my car and my medical marijuana card. And he was like alright ill run this through and come back. (I handed him the green receipt you get back when you send the $100's to the state, with the date the check was cashed at.) And he comes back saying thats the the proper paperwork thats needed, he immediately puts me under arrest after i told him im not giving him consent to search my car. They begin searching my car for more weed and find nothing but seeds. My buddy takes a PBT and blows numbers and gets an MIP, I deny a PBT (I would have gotten a DUI or OWI) instead i just got a denying a PBT which is 100 dollar fine. They impound my car, take my weed, card and parifanilia.
I got tickets for the following
Excessive noise (muffler) waivable
Taillight out waivable
Restricted license violation
denying PBT citation
drug parifanilia
posession charge

I am very thankful i didnt get a DUI or OWI.. but still very pissed off about the situation..


..anybody know about law here that can help me out??

I think you're right rzza...

Did you get tickets but not go to jail...or did you have to bond out of jail for this?

Get a lawyer like yesterday!

Sound like if you would have cooperated they were going to take you in! As MM card holders you have to follow the rules of the law to the line. All they need is a violation or two to make your life inconvenienced because they can. I hope that this does not cost you as much as a DUI/OWI after the attorney, fees and fines. :leaf::leaf::finger:

It's the truth brother. You just sacrificed you driving privileges for a year. The officer should have given you a warning regarding that.

I'm so glad that this information is being shared. I now have a somewhat better understanding of what could happen to me if I were in the same situation. I will try to be preventative, especially while driving. No smoking MJ in my vehicle, if I do smoke before driving wash hands and spray down with Fabreeze to help with getting rid of the MJ order. Make sure that my insurance, license and tags are up to date. Any alcohol, MJ, or anything associated with MJ is in the truck area (if they do a search it may not matter too much). Don't speed, drive too slow, or violate any traffic rules. Make sure that my vehicle is in good operating order, no busted lights, loud noises, or smoke coming from my vehicle. Try to avoid anything that will draw attention to me while driving with or without MJ on board. Answer questions truthfully and don't refuse anything they ask me to do...Doing this I might be able to avoid getting pulled over and made an example of.:leaf::leaf::finger:

No offense, but it sound like a bunch of underage kids in a car rollin around gettin f'd up. Any cop is going to have a field day with this type of scenario. Rule of thumb is same as always, don't smoke or drink and drive. It's illegal and will land your ass behind bars.
My advice, get a lawyer, like yesterday!!
In my opinion, we should still act as if weed were still illegal. Have it locked up out of sight, sealed, in the trunk, etc. Don't smoke in the car, make sure it doesn't smell,etc. Your MM card should be your absolute last line of defense. Be smart, and you will avoid most if not all potential probs with LEO. Best bet is to attract as little attention as possible at all times, taking into account your driving style and what you are driving.

This. As stated previously, absolutely get a lawyer and do not say/do anything in presence of LEO or a judge without first consulting him/her. They will can and WILL use what you say against you. I've never been involved with a MJ charge, but I've been through the judicial system enough to tell you that anyways.

:leaf:yeah i am 25 i have my paperwork waiting for my card...... when I was 17 I got a felony for trafficing alil weed when I say alil I mean mexican brick weed 15 dime bag's needless too say went to jail paid alot of money went on p o....year later bam got caught well snitched out by my ex girl and sum salty friend's fucked my p o up bla bla bla well now 8 year's later I got my shit right I work I pay bill's and I chill! BUT I bet 100% when a cop pulls me over run's my name see's me felony for drug's and there gunna fuck with me its a given I already tell thm to search my car and that I got a felony before I give them my shit! but I keep everything locked up in my truck in a locked box .. I hope the best for you cuz when your young the system hate's you! but if u had the weed in ur pocket car full of homie's buzzed up the cop 1 prolly think's ur sharing ur med's and 2 think's ur smoking and driving considering it was so easy to get it for the cop's....i hope for the best!!!!!! police should be casing the guy that killed my brother or maybe the crack head that robbed my grandpa but no they pick on th plant the one thing that we can grow that help's with pain without taking viks and oxy's...... thishas been my frist post of many glad to have chated with u all and have a blessed day:leaf:....

Yeah, you maybe right. You just couldn't be you're own caregiver.
R 333.125 Revocation; nullification.

(3) Any person who has been convicted of a felony involving illegal drugs
shall not serve as a qualifying patient's primary caregiver under the act.
