Is there anything in the law that protects patients who are growing from being charged with a felony for having a firearm in their home?

Why would you get a felony for having a firearm just because your growing? They can't take rights away simply because your a caregiver

I'm not a caregiver, just a pt.. I am an avid hunter. I have a lot of guns. Say I harvested a plant and it turned out to be 2.8oz and I happened to get searched that day. I would be over my limit, therefore I'd be charged with felony manufacture and on top of that a felony firearms charge. At least that's what I'm thinking.

who ever harvests more than there limit! cure time etc all are factors just because you chop up a plant doesnt mean you can smoke it or want to explain to the cops its like a fine woman it has to mature

I guess you're just gonna have to share the love, and smoke that entire 8.5 grams extra with some buddies instead of holding onto it so you never have to find out! In fact, if that does ever happen, I'd be more than happy to take the extra off your hands so you are down to your limit lol! ;-)


On a serious note, you do bring up a valid point, and is yet another example of why our laws need more clarification.

Not only more clarification but also, if someone is over there limit it shouldn't automatically default to a felony either.
 
federal law, growing marijuana is a crime.
having a firearm while committing your crime is also a federal offense.
the feds will come down on you like 2 tons of bricks for having a firearm in close proximity of your grow.
they are also used as a plea bargain tool.
 
it wont be the feds until the locals get you on a gun charge while busting down your door for any reason. Dont give them a reason, stay small, keep your head down and your mouth shut and you will be fine

Well, what about the caregiver that just shot and killed the kid breaking in his house. Didn't sound like he was charged...


I have absolutely 0 criminal history.

I don't have any guns just for this reason. I am not doing anything wrong but I am certainly not giving them anything else to burn me on. Having a gun in commission of a felony in my state adds years to a sentence and screws your chances for a low bail, etc. Sometimes it's worse than the original crime because they now can call you a violent criminal.

It's too much of a grey area for me so there will be no guns at my house until growing is not a crime for anyone not just patients and caregivers having so called state protection... .
