It wasnt misleading at all. It was a news reference from a long time ago. You are choosing to reply to dated news media, thats all. :)
Maybe not to you , but it sure was to me . I know some other members felt it was misleading as well . The title makes it sound like the dea stake out homedepot to bust growers . Why does it matter the date ? That has no bearing on the accuracy of the title . If you read the thread it states a dea agent was in the store - it does not say he was on or off duty . If he was there to buy something for his home or what . That title could make anyone who bought a bag of lime and a couple other things at home depot for a grow nervous if they are not in a legal place . Thats how I took it .

More like why are they following people just because of buying soil at a store. But hey, why not encourage others to investigate others at a public home improvement store, right? I dont mind having no rights about buying things in public legally for the fear of prosecution. The reason I mention it is dated is because it is. The bust went down a looooooooong time ago. :)

Yeah right thats what I thought too . But now the law is not to keep us free - its to throw people in jail .

I'm guessing they are monitoring large fertilizer purchases because it can be used for "bomb" making.......... then after seeing the additional purchases, they realized it was for pot and not bombs. So many people get caught because of stupidy.......

Here's the guts of what you need to know, the tactics of your DEA. One more for GO TORONTO eh?

"On May 28, 2007, a Drug Enforcement Administration (“DEA”) special agent noticed a group of men purchasing a large quantity of fertilizer from a Home Depot.   Recognizing the fertilizer as a type frequently used to grow marijuana, he followed the men as they left the store and saw them drive away in a silver 1997 Jeep Grand Cherokee.   Law enforcement later identified one of the men as Juan Pineda-Moreno, the owner of the Jeep.

In June, DEA agents obtained information that Pineda-Moreno and his associates had purchased large quantities of groceries, irrigation equipment, and deer repellant at several stores.   On several of these occasions, the group traveled in Pineda-Moreno's Jeep. Agents eventually followed these individuals to a trailer home Pineda-Moreno was renting at the time.

After learning where Pineda-Moreno lived, agents escalated their investigation.   Over a four-month period, agents repeatedly monitored Pineda-Moreno's Jeep using various types of mobile tracking devices.   Each device was about the size of a bar of soap and had a magnet affixed to its side, allowing it to be attached to the underside of a car.

Agents installed these devices on the underside of Pineda-Moreno's Jeep on seven different occasions.   On four of these occasions, the vehicle was parked on a public street in front of Pineda-Moreno's home.   On one occasion, it was located in a public parking lot.   On the other two occasions, the Jeep was parked in Pineda-Moreno's driveway, a few feet from the side of his trailer.   The driveway leading up to the trailer was open;  agents did not observe any fence, gate, or “No Trespassing” signs indicating that they were not to enter the property.   The agents entered Pineda-Moreno's driveway between 4:00 and 5:00 a.m. and attached the tracking devices to the Jeep. Once in place, the tracking devices recorded and logged the precise movements of the vehicle.   Some of these devices permitted agents to access the information remotely, while others required them to remove the device from the vehicle and download the information directly.

On September 12, 2007, information from a mobile tracking device alerted agents that Pineda-Moreno's vehicle was leaving a suspected marijuana grow site.   Agents followed the Jeep, pulled it over, and smelled the odor of marijuana emanating from a passenger in the backseat of the vehicle.   The agents contacted immigration authorities, who arrested all three individuals in the vehicle for violations of immigration laws.   Pineda-Moreno subsequently consented to a search of his vehicle and home.   In Pineda-Moreno's trailer, agents found two large garbage bags full of marijuana."

I'm glad to be Canadian some days.
I hope that this isn't the only thing they used as probable cause to start the investigation. Every fert they sell at HD is frequently used to grow marijuana, along with a HOST of other plants!!!! That would peg every potential buyer of fertilizer as a possible pot grower!!

Well it would seem that way to me but that mexican got busted by the dea . Theres so many where I live you dont ever feel like anything unusual is going on I see at least 20 -30 mexican landscapers a day . Pretty soon they will all probably be under surveilance .

Constitutional Rights aren't based on citizenship. EVERYONE has a Constitutional Right against illegal search/seizure and attaching a GPS device without a warrant is unconstitutional as recently confirmed by SCOTUS.
The constitution ONLY applies to citizens. Only citizens have "constitutional rights". Every one has basic human rights, but only Citizens of the United States have any protection under our constitution and bill of rights.

These are the most corrupt that break every law they can get away with . Plus they probably bring more crack into our country than anybody else . I cant return their hate or wish them ill wishes . Just wish they went away .

This is an incorrect statement of law. The US Constitution indeed applies to non-citizens and they are entitled to constitutional rights. See Boumediene v. Bush.

True, but the question in Boumedine was a question of Habeas Corpus, not of a "constitutional" issue. Habeas Corpus is not a constitutional issue, but a right of all "free men" that goes back to King John and the the Magna Carta, upon which our idea of inalienable god given rights was founded. Our constitution does indeed protect any mans right to Habeas Corpus to address any human rights or basic individual rights protection, so in that sense you are right, and I stand corretced.
The info I went on had been brought to the US Supreme Court in the '80s when we were indefinitely detaining the Marielito Cubans in our Federal prisons, where INS had prevailed by stating that our constitution only guaranteed rights of US citizens.
