Charged with Possession

Hey everyone, I would appreciate some input on what I am going through currently.

I live in Milton, Ontario currently.
Last month, I was charged with possession of marijuana under 30 grams. This was in Mississauga. Me and two of my friends were smoking weed in my car by a Hasty Market. We know the owner of the hasty market very well and we've been toking up there for many years. We've been caught there before, one time. The cops were incredibly cool and they were joking around and they took the weed and just left and said, "smoke somewhere else next time". This laid back event perhaps encouraged me to not move from that spot even though I should have. Unfortunately, the next time we got caught, it was so much worse.

The cops were assholes. We were extremely polite with them, we gave them everything we had and they still charged us. This is the first time any of us were charged with any crime. I had about 2-3 grams on me and my other friend had about 2 grams. The other person with us had nothing but nonetheless, we all got charged for joint possession. We also had 2 grinders in the car.

Apparently, they came because of a complaint. The person who made the complaint was there and he was constantly bitching, telling the cops to charge us.

To sum it up, about 5 grams, charged as joint possession between three people and paraphernalia as well. None of have any priors. My court date is next week, in Brampton. Do i need a lawyer? Will the judge most likely just drop it since we are first time offenders? Its hard to imagine that I would get a criminal charge for 3 grams of fucking marijuana, this is so stupid. Anyone here that had similar experiences?

Thanks guys.

Hell yes, get yourself a lawyer. The prosecutor is unpredictable. Assume the worst. That he will seek max penalty. The money for a good lawyer is 10 times worth the time he will save you from prison.

Good luck. Let us know what you decide to do.

i'm not familiar with canadian law as i've never been arrested in canada, but here in the us, we usually have one get out of jail free charge, so long as the charges are pretty minor, such as simple possession.. what this get out of jail free card means, is a conditional discharge of the charges.. the condition is that you don't get into anymore trouble for the next year or so, the charges will be dropped.. this may or may not come with probation in which you have to report to a probation officer, usually monthly, sometimes much more often, and submit to random ua's.. once the year is up and if you don't get into anymore trouble, the charges won't show up on your records..
and i agree, always, always, always pay up for a lawyer w/e you have any charges, any charges. lawyers can work deals with the d.a. that you'd never be able to get by yourself.. i know it blows paying these bottom feeder, lawyers, but it's worth it in the end..

Yes, absolutely, it's worth it in the end. OP, don't go into court when it's just you vs. a professional prosecutor whose main interest is his conviction percentage. There's no way you can compete against that. So hire someone who can.

Good luck man. Get a lawyer and stay out of prison.

i think it depends what your charges are as to whether or not you'll be denied a pass port.. i have a possession charge and have been all over europe after getting my visa years ago.. sure, some countries might not let me in now, like i hear australia is pretty tough to get into, but as far as getting a pass port, i don't think a simple possession charge will stop that..
again though, disclaimer, i'm far from a lawyer, have just been through my fair share of bullshit in the past and speak from my experiences for the most part.. :D

its only not worth it . if your going to take a DEAL anyways.. in this case.. more then likely. u don't need one just because.. 3 people 5 grams.. proly be a slap on the wrist.. but if u wana be sure.. get a attorney or lawyer.. whatever u can afford and look for someone who deals with drugs a lot.. people specialize in getting drug charges dropped and lessened..
