Health and Safety Code 11362.71 (f) It shall not be necessary for a person to obtain an identification card in order to claim the protections of Section 11362.5 (Compassionate Use Act of 1996).

Does this mean that even if one doesn't have a medical marijuana card one can go and get one if they get in trouble with the law?

If so would one be arrested and held until bail/trial or would one be assigned a court date at which time they could have gone and gotten a card or is there some other process by which it would work?

It means someone with a qualifying condition doesn't need an actual card to use/grow medical marijuana in california.

Only a doctors prescription is technically what's supposed to be needed and even that is questionable. Californians think you have a right to treat your own pain whether you can pay the state protection money or not.

You'd be on your own because you couldn't buy or even go into a dispensary, and you'll still face being arrested or worse but you'd get let go and charges would be dropped if legit and you can prove it somehow like medical records.
 
short answer is no heres the long one though . I am a legal mmj user in ca and what you got there is a tiny portion of senate bill 420. its a law that puts limits on the amount you can grow or have. It also requires counties to implement mmj card programs. now by ca law you only need your doctors recomendation to grow pocess or even visit a dispensary its the county cards that are not necessarry but you have to have your dr. reccomendation

All you need is the recommendation. The card shows that it was verified by the county health department. Law enforcement does not have to recognize the recommendations. The court does. Without the card you may or may not get arrested, but you will be released during your prelim and your property returned. You have a right to sue for property damage, but having a card might help.
What it amounts to is unequal protection under the law. Buying a card is equivalent to protection payments. I'm surprised there's no outrage. I do not register and pay the county for the right not to get arrested when I get fill prescriptions at Walmart.
My county recently lost their case not to sell the cards. They go on sell 10/14. In 3 months I have to renew my recommendation and would have to renew my card as well. That's at $166 a pop to the county. I'm not going to bother. When I renew I doubt if I do either. Perhaps if I get harassed in the mean time, but the bottom line is it is protection and nobody should pay it. If I don't pay it, it will be easier for the next person not to pay. It's voluntary, BOYCOTT IT!
 
yeah i couldnt agree more. the way i see it the county card programs are extorting money from us for protection.. i dont have a county card and will never get one. san bernardino county can kiss my ass!!

feel the same here besides in riverside county cops dont care as much about pot is all about the meth so they are more lenient even without a recomedation plus then u can have more plants than sb 420 states since ur not binded by it with the card or thats how a supieror court ruled

I'm in san bernardino county as well. North of Palm Springs.
I was relieved to see the county issuing cards, but as Mr. Twitty said...They can kiss my ass.
