I need help I am a MMJ card holder
I was unable to find any laws on my county as I do know every county has a different restrictions on outdoor growing so will the law 6 mature OR 12immature plants apply to me?
Also I have a friend who also is a MMJ card holder would we be able to grow in the same property(greenhouse)
without any problems or Is this illegal.
Should I have his recommendation letter next to mine? or
Should I get a caregiver recommendation?
would really really appreciate your advice, not looking for trouble. Only CA residents please...

Im a ca med patient too and i xeroxed a copy of my rec with a copy of my dl and stapled it up at the entrance to my grow. I also came across an interesting bit of info. Check it out for yourself and run a google search on the "kelley case". I printed a copy of that too and stapled it next to my rec also. Basically,( and cali supreme court ruled in favor of this, ) the original prop 215, as enacted by ca voters DID NOT HAVE A PLANT COUNT. And according to the ca constitution here ill quotr this " under california constitution, article II, section 10, subdivision (c), a statute enacted by voter initiative cannot be "amended" by the legislature unless the voter initiative expressly gives the legislature the right to do so. Prop 215 did not give the legislature the right to amend the measure." "The CUA-compassionate use act(prop 215) does not specify an amount of marijuana that a patient may possess or cultivate; it states instead that the marijuana possessed or cultivated must be for the patients "personal medical purposes"(H&S code S11362.5, subd. (d) anyway to make a long story short and skip through all these million dolkar words, heres the important paragraph " the court of appeal held: (1) section 11362.77 is INVALID(<<<plant count) under california constitution, article II, section 10, subdivision (c), insofar as it amends, without approval of the electorate, the CUA, adopted by the voters as prop 215; and (2) section 11362.77 (and by extension the medical marijuana programs id card scheme) is thereby rendered wholly UNENFORCEABLE. The supreme court granted review to address both of these issues." They have since changed the "8ounces, 12 vegging or 6 mature plants" to "an amount consistent with the patients medical needs" our government added the plant count to the original law which the supreme court declared unconstitutional. In fact prop 215 never mentioned anything about having to get a recommendation even. And these prescribing drs are also trying to sell a cultivation permit which supposedly allows u to have up to 99 plants for $100+ which is complete bs cuz there is no such thing in ca law as a cultivation permit. The id card is supposed to protect u from arrest but u dont need ur med card to use medical marijuana as a defense in court. And u dont need an extra paper from ur dr saying that u need more than the 8ounces lie. Prop 215 originally only required a dr to recommend cannabis as a medical treatment(including just a simple verbal statement-no paying $$$ to get it on paper)

I think this is the last one i got lol feel free to print a summary, or the whole damn documents hahaha and highlight the important parts so if u need to reference them quick to leo to stand up for ur rights and stay out if jail and keep with ur rec at the entrance to ur grow. If u have other ppls recs too, med patients r allowed to form collectives to grow together too which would help spread out the limits over several ppl. I suppose if u had a backyard full of 8 footers, it might look a lil better to say that is the supply for 10 patients as opposed to trying to explain how thats personal use. Also if there are kids in the house i would strongly recommend locks preventing them from having any possible access to ur meds, grow, etc cuz u know how cps is out here. I have 2 different locks u gotta get through to get to my grow and even my wife doesnt have the key or know the combo. Oh and dont have any guns in the house and personally i stay the fuck away from scales too

I know someone with 3 greenhouses on their property in the desert and its his personal. He pretty much turns it all into hash and smokes hash by the bowl. Oh ya i think i came across something that said only the buds were supposed to counted against the limits(not hash, kief, edibles) but ive also heard their trying to make wax a felony cuz it goes through a "chemical process"(the butane) lol but idk im no lawyer just trying to stay informed to save my own ass should the need ever rise up again

It also wouldnt b a bad idea to invest in a security camera dvr setup either to protect urself against these cops who abuse their powers or god forbid anything else that could go wrong

And b sure to educate others in ur home(wife,gf, whatever) on ur rights. If the cops show up at the door, u dont even have to open it or talk to them. If they had a legal reason to be there, they would be making forced entry. They can only do what u give them consent to do unless they have a warrant

Thank you so Much no Kids around i will be growing at a 10 acre property just dont want to be caught and busted for cultivation would you think 10 mature plants for myself is too much? Since there is no limit count its my first outdoor i appericate your advice

That sounds reasonable to me. I wish i had some property like that to utillize. I was gonna move into a house with a 6' wooden privacy fence around the backyard and i was planning on devoting half the backyard to a plot and since it was in a neighborhood i was gonna add 1 1/2-2' of lattice ontop of the fence with some shadecloth on the side facing inward but the deal fell through unfortunately. If u r planning on growing on a chunk of land id also research guerilla growers tactics too for the eyes in the sky. With proper spacing and training youd be amazed what is pretty much invisible even from the air. I think the plant count is stupid cause lets say your 10 outdoor plants would produce significantly more flowers than say my 10 plants indoors. Also depending on what part if the state your in too. LEO up in humboldt, mendocino counties area got bigger fish to fry than someone with 10 plants. I know down south here in the IE ive had cops tell me point blank they dont give a shit about the weed;theyre after the meth n guns. I would suggest taking multiple things into account when planning out the gameplan. What do u feel comfortable with legally. How much crop tending are u willing to devote? Personally when i feel safe and secure with whatever ive got going on at the time, i worry less and have much more time and concentration to learn, work on my crop etc and with peace of mind i can enjoy the beauty of my plants and take my time to do it right

My very 1st grow i was 14 in my closet and there was no medicsl program at all and i literally got so paranoid that i learned how the cars sounded coming down the road and i could tell jusf by sound which car it was and if they belonged in our neighborhood or not. All those brain cells could have been put to better use learning more about cutivating stuff

r u worried about 10 plants? do u have a rec? r thr tons of other ppl growing a lot more than u in ur county? I wouldnt worry about cops. rippers bugs and mold will b a bigger issue. if u r that worried just space ur 10 plants. buy a white canvas tarp paint a red medical cross. get ur rec blown up nail it to a piece of plywood.

Under the guidelines, qualified patients and/or their primary caregivers may possess no more than eight ounces of dried marijuana and/or six mature (or 12 immature) marijuana plants. However, S.B. 420 allows patients to possess larger amounts of marijuana when such quantities are recommended by a physician. The legislation also allows counties and municipalities to approve and/or maintain local ordinances permitting patients to possess larger quantities of medicinal pot than allowed under the new state guidelines.

I also came across a clarification but cant remember what site i saw it on that supposedly was written by the same ppl that drew up the sb420 and in it they stated that the 8 oz, 12 immature, 6 mature plant guidelines were meant as a threshold or minimum and not as a cap on the maximum. Hold on im gonna try to hunt that down and will post a link if i can find it again.

The 10 acre property isnt covered in. Trees at all or else i would just plant few here and there anyways i do have a rec i just ordered a greenhouse 10x20x8 i just worried cause its my first outdoor grow and i am only 20 years old i do not want to be busted with cultivation lol its not like im growing 99 plants like people ive seen and get away and i live maybe no joke 3 miles from a police station i dont see why the would bother me. If i am growing in a 10 acre property gated all around private and secure from kids and not near the city more bound to the country maybe im just paranoid going over 6 mature plants lol i will post my rec on my greenhouse and i.d together i should be solid

Im in la county and i have 30 patients im a caregiver for. 6 plants for each of them, plus my rec is for 50 for myself. The law in la county for outdoor is you need 5x5 feet of space per plant is what i was told by cops. You shouldn't have to pay extra for more than 12 plants but your doctor can write you more than 12 based on your need for medication as part of your recommendation.

Concentrates of any form are not considered medical and are not covered my ca mj laws. 100% illegal even if you have a rec.
