Black flying bugs crawling on my soil

They're black and for the most part they stay away from the leaves except for some small black spots on some of the leaves which I'm guessing is scat, because it's not spider mites. I've checked with a scope, plus none of my leaves are stippled with black or white dots.
Some of them just crawl, and cant fly, but today I noticed there are more flying than usual. They're too small for my camera to take a good picture.
At first I thought they were just gnats, but there are some leaf issues that can only be explained by bug issues so I'm worried now that they're aphids.
Anyone know what they are and how to get rid of them?

While I'm at it, on my outdoor plants there are little oval shaped black bugs with a white stripe through the middle. They jump high but don't fly. Can anyone that has these tell me what they are?

beansly im by far an expert but this year in my garden(veggie) i had a run in with these creatures. they tore my eggplants to shit.. they sound like flea beetles,and there are many differesnt flavors. check out the link ..

neem doesnt seem to work too long,sevin dust works but Not on my meds..

ANYWAYS....................

So I still think they are fungus gnats. I always thought they were but I didn't think gnats could cause plant problems cause I've never had them before.
How late into flowering can I use gnatrol?
 
take a 2 to 4 inches of soil out of top of pot,throw away the soil, replace with paver sand (home depot ) in garden section, no more gnats ,its what i did and have been doing to all my plants(its from watering to much)

Sucks.. I saw a few buggers. I killed them.. They dare not return.. Good luck man. Post a pic of the bug
