Are weed seeds patented?

When you buy seeds from a breeder are they patented? Meaning you cant grow your own seeds. Or are there currently no patent laws?

I know on soy bean seeds a company called Monsanto has patented the soy bean seed, just wondering if anyone knows if someone has done the same with weed seeds.

Yes, they are patented... If you try to grow your own seeds they will only produce watermelons after that....


(p.s.) You cannot patent something illegal...

bingo.. you can't patent say the ingredients to make lsd or any other illegal substance including cannabis seeds...

as far as using some people's work to create your own strains, it's a bit of a blurry line as some breeders are all for sharing, and some others definitely get pissy if you use their gear to create other strains that you're going to sell for money..
to me, i don't really see a problem with it.. pretty much all the strains today come from a very select few older strains like skunk number one, haze, etc, etc.. if the og breeder or finder of those strains wouldn't have allowed others to use their gear, we wouldn't have things like og kush, sour diesel and plenty of other hybrids..

I am not sure, but I think you have to make a direct genetic modification in order to get a patent on a living thing. The process I use for my seeds is not patented yet.
