doesn't say anything about it being premeditated. what if they were just sitting there drinking some beers and suddenly decide that blacks are not welcome in their bar of choice?

should these two be punished just the same as someone who commits assault and battery on someone who spits on their girlfriend, or should they face a more severe punishment?

is beating a black person for being black more heinous, less heinous, or just as heinous as beating someone for spitting on your girlfriend?

Hate is hate, my point being, hate is not illegal. Or are we now suggesting that there should be a thought police? Hate crime designations borderline on thought policing and are a slippery slope to tread on. Further, by designating a group of people as protected is a form of discrimination, regardless of the legislation's intent, because you are singling them out of the whole for special treatment. An action, which, by its very nature, also foments ill will toward that specific group, because they are seen as getting special treatment or extra attention. Jealousy is human nature after all.

Perhaps a better comparison would be that I hate stupid people, but since it's not a designation considered to be a special portion of society, there are no laws which specifically state that visiting harm on someone, because you believe they are stupid, should warrant some special punishment or consideration. Should we call our legislators and demand tougher penalties for those who commit crimes against stupid people? You think the courts are backed up now?

Thus the reason there are different degrees of assault. But they make no special dispensations with concern to any group the victim or perpetrator might or might not belong to, and they shouldn't.
