A REAL commitment to change the 25-mile rule

I've said repeatedly that I would support changes in the 25-mile rule. Now I'm putting my money behind my words. I'm committing $10,000 to changing the law through a citizen's initiative. There are two strings attached:

1. Polls have to show a 40% approval for the specific changes that would be in the new initiative
2. The money will be used as a match with other funds committed to pass the new law.

Like many people interested in running dispensaries, I am a cultivator first and a businessperson second. I've enjoyed the benefits of personal growing and believe that individuals should have the right to grow a natural plant in the privacy of their own home. Got that, but that's not the law and personally I think there are a lot of immature people who wish the world was different, and howl at the moon, instead of dealing with what really exists. Sorry, but that's what i see.

There is a separate question underlying a lot of the hostility towards dispensaries here - not from patients but from caregivers who see this as a source of income. Much like Colorado, I think there is a possibility of creating a role for caregivers in the production of marijuana for dispensaries and directly to patients. Get it in the new law, stop complaining about the existing law.

The Arizona law is very anticompetitive by restricting the business to dispensaries. I have never said otherwise. What i have said repeatedly, and what the winers don't want to admit, is that the law never would have passed in this conservative state without the 25-mile rule as that attracted both money and votes. I was not involved in the writing of Prop 203, and would not have supported the 25-mile rule, but in retrospect it was the difference maker in a 5,000 margin election.

Another thread mentioned the possibility of the legislature making positive changes in the 25-mile rule. First, are you kidding? These are the people who banned medical marijuana from college campuses. Second, it takes a 3/4 vote of both houses - not going to happen.

So, lovers and haters, let's get together and change the 25-mile rule. Would love to work with you on how to create a majority of arizona voters to support changes in the 25-mile rule. you don't have a majority now and you need it - i can help you get there.

I can agree with you on lots of what you posted here... however it's hard to tell what a single patient can really do...

So.. what can I do? As a patient that has a chronic illness and requires a serious amount of medicine (marijuana and pharmaceuticals) to manage my pain and symptoms, I also find myself financially restricted as I am sure many others do as well.

I went to the hospital half a dozen times in the year before the MMJ bill passed and I started cultivating my own medicine, and have only been back once since. I feel without access to an organically grown high grade product at a cheap price, or the ability to cultivate it myself, I will be a further burden upon tax payers and the state by spending weeks of my life each year in the hospital.

What ideas do you have that could help in this journey? I despise the hospital and my lack of control over the future of my cultiviation rights..I really feel that marijuana is a healing medicine.

you're allowed as a caregiver to grow for a patient if the patient lives more than 25 miles from a dispensary. you can live right next to a dispensary, have a legal grow in your house of 12 plants for a patient, and share the harvest.

You are telling him to break the law. Once the 25 mile rule is in effect, and you caregive for a patient outside of the 25 miles, you can't use their medicine.

Damn is that illegal? I actually already sorta had this plan... however dealing with anyone 25 miles out in the middle of nowhere so I can get my legal supply does sound like quite a hassle ;\

Once again his Harvard education fails to serve him..... basic reading comprehension is taught in Harvard id imagine. (or at least a required skill set for incoming students...)

Are you sure it wasn't ITT's Harvard campus?

Who the fuck gets into the MMJ scene with a degree from Harvard?? If you went to Harvard you would and should pretty much be a law expert or well educated in politics/law.

If you want to keep growing, move out of the 25 mile area yourself. Sad, but true.
Sadly the state is measuring the 25 mile rule, "as the crow flies" and they will be very few places suited for the law. Greenhouse/outdoor has the advantage here, but if you want to find a good place to farm your indoor, I suggest you move to another state or find a patient on the res..

AZDHS did a very good job of fucking with patients w/ the 25 mile rule.
Doesn't the AZ constitution suggest that no citizen is has to be subjected to utilizing a state run health care facility. I believe it also says that no citizen (patient in this case) will have unequal benefits to a state run program. So just because someone lives 25 miles away from a dispensary, they should not be able to have more rights than another patient with the same ailment, who is considered equal under the laws except for physical location?

Also, The 25 mile rule only makes it easier for the DEA to come in and and say that these businesses, dispensaries, are engaging in criminal activity, since the 124 ops will be the only suppliers.
Property forfeiture is coming to AZ and the politicians/health dep. love it....

I forgot you can have your patient donate some to you as patient to patient. My bad.

I dare you to go onto indian land and show your card and or have any medicine on you. You will find yourself in jail and your vehicle and property sized. NCF your obviously a intelligent person having gone to Harvard you better do a little research on how the Arizona Native Tribes feel about our MMJ laws and what will happen if they catch you on their land (including a stretch of the 101 in town) with any amount of MMJ.

AZ Medical MMJ laws are null and void on the reservation. The card means nothing. You cant be a Patient or a Caregiver on the Reservation at all. Even if your a member of the tribe. If you want to have a card and be a patient or caregiver you CAN'T live on the reservation.

This is what I have been waiting for. I commend you Mr Gaines in what you are proposing to do. I apologize if I have offended you. It seems that we are all on the same page here going forward and while we may differ on some points we all want the same thing in the end and Mr Gaines is one of the few who can help us all make this happen.

I disagree with what your saying. While having a card on the reservation is worthless legally to the nation. The state will issue one as the nation is in the state of Az. If they were to say no they would open themselves up to a litigation. That patient could come to town and get medicated.

However I do want to reiterate what was mentioned above to attempt to grow or transport would definatley get you ass fucked!!

I am not sure the state would issue you a card if you have an address that is on the reservation I could be wrong but technically I believe indian land even within the boarders of Arizona is not part of the state it is sovereign land therefore the state wouldn't legally be required to issue you a card if you lived there. Either way if your caught with any amount of MMJ on Indian Land card or no card your vehicle and any valuable property you have is getting seized. There was an article about it in the New Times along with a statement from the Pima Gila Indian LEO.

I am with irie, all this animosity will get us nowhere. Regardless of how I feel about CFCC prices, it is his business and he gets to run it the way he chooses.

Mr Gaines, I believe some tangible evidence clearly showing a step toward helping the amendment process would sway more advocacy than words/good intentions. If there is possible light at the end of the tunnel I would happily contribute funding to the cause.
