you did not answer the question.
When was Article I, Section 8, Clause 3 ratified? All amendments to the constitution have to be ratified in order to make it law.

Quote:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. Clause 3: To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes; CONSTITUTION OF THE UNITED STATES OF AMERICA, PROPOSED BY CONGRESS, AND RATIFIED BY THE LEGISLATURES OF THE SEVERAL STATES, PURSUANT TO THE FIFTH ARTICLE OF THE ORIGINAL CONSTITUTION (See Note 12) Note 12: The first ten amendments to the Constitution of the United States (and two others, one of which failed of ratification and the other which later became the 27th amendment) were proposed to the legislatures of the several States by the First Congress on September 25, 1789. The first ten amendments were ratified by the following States, and the notifications of ratification by the Governors thereof were successively communicated by the President to Congress: New Jersey, November 20, 1789; Maryland, December 19, 1789; North Carolina, December 22, 1789; South Carolina, January 19, 1790; New Hampshire, January 25, 1790; Delaware, January 28, 1790; New York, February 24, 1790; Pennsylvania, March 10, 1790; Rhode Island, June 7, 1790; Vermont, November 3, 1791; and Virginia, December 15, 1791. Ok, sorry to point out that you're wrong once again.
THE ENTIRE CONSTITUTION WAS RATIFIED AT ONCE, ALL SEVEN ARTICLES. THOSE SUBSECTIONS YOU'RE TAKING ABOUT ARE CALLED AMENDMENTS AND THERE ARE 27 OF THEM. Get your head out of your ass and come up with some facts. United States Constitution - Wikipedia, the free encyclopedia |

Article I, Section 8 is part of the original constitution and not an amendment to the constitution.
But, back to the original topic of this thread ... what's wrong with this picture: An ill woman, operating within state law, is arrested by federal agents and thrown out into the street in her wheelchair. Two Border Patrol agents come in contact with an illegal alien crossing the border with a couple hundred pounds of pot in his possession. In an attempt to make the arrest, the Mexican is shot in the butt cheek. The Mexican goes free and the Border Patrol officers are doing time in federal prison for assulting the Mexican. Something just ain't right in Paradise. Vi

entropic, please explain where I backpeddled?
Vi Knows me well enough to know I don't back peddle easy.... If anything I was asking you to define yourself with a bit more clarity. Amendments to and subsections added to the Constitution must be ratified as well in order to make them law. Other's here who have known me for a long time know that I happen to know the constitution quite well.

Here is what I was getting at: Tenth Amendment to the United States Constitution - Wikipedia, the free encyclopedia
You know, states rights... "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved for the States respectively, or to the people." You may want to look up other cases where the states rights won out. This is one that comes to mind. United States v. Sprague - Wikipedia, the free encyclopedia Of course there are other cases where the Supreme Court has decided against the 10th amendment. It seems that they government and the Supreme Court is selective when it comes to that certain amendment of the United States Constitution. You see I'm a little sharper that you may think.
