I am counsel seeking clarification on behalf of a client. If a patient’s license to produce and authorization to possess are protected by the Allard injunction – can that patient register and purchase from a licensed producer using a medical document and continue to retain their Allard protected rights to grow and possess pursuant to their license to produce and authorization to possess?

Not sure what this is, but I was always under the impression that you cannot be a part of the MMAR and MMPR simultaneously. I thought the government wanted people to submit their pink personal production license if they were a current MMAR patient who wanted to register with a LP. I know some people who have signed up with an LP and refused to surrender their PPL, however I'm not sure how valid either one of their "licenses" would be at that point.

when i called HC, they told me they have no way to cancel or change your license so i guess you could sign up for a LP and keep your pinks. that's why we can't change addresses either. supposedly the spreadsheet is locked...magically of course
i wouldn't give mine up....especially to a LP

I have heard of patients being able to keep there pink while obtaining a membership with a LP. What the result will be within there internal system incase police use the contact number is unknown. Why only come by when you need something? Jw.

there was a quote from HC that sec 126 of the MMPR doesn't allow you to sign up for more than one "producer"...the thing that made me shake my head was that the entire MMPR was ruled unconstitutional so why throw ANY argument from the MMPR?? makes them look foolish...but then again, it's not unconstitutional for another few months yet

Per Scott McCluskey former Coalition Executive Director:
As soon as your doctor authorizes any dosage increase always get them to write it out on his prescription pad as well as fill out the MMAR B-1. Since doctors do not prescribe cannabis, but only AUTHORIZE it's use, then the moment that he writes the new AUTHORIZATION it is valid. HC does not have to process it through the MMAR to make it valid as long as tou have it written as mentioned above on a doctors prescription pad. I might add that, it is for PMU, PERSONAL MEDICAL USE. Just cause the MMAR is supposedly repealed, does not mean you cannot under grandfathered licenses make dosage changes.

Mr. Tousaw claims that there is no need to inform HC of supposed dual sources. For example, if you have a grandfathered license but were not up and running, because address change issues, or getting screwed by a DPPL holder, and you applied to a LP through the MMPR, you would NOT be double dipping and it is not necessary to tell the LP that you have a grandfathered MMAR.

Here is the HC answer::
It is important to note that as per section 126 of the MMPR, it is prohibited to seek or obtain dried marijuana from more than one source at a time on the basis of the same medical document. If an individual wishes to seek marijuana for medical purposes from more than one source they must have their healthcare practitioner complete a new medical document.

So just get an MMPR, LP form of the LP of your choice off their website and order what you need, with your doctor authorizing the new form and send it in.

BEing healthy is what its about!

by the way...the MMPR is UNCONSTITUTIONAL and worthless as it stands!

2 things I want to say. First if you want to buy from MMPR just go find one of the meany pot dr's get an MMPR script and you are good to go regardless of your mmar status.

Second thing is FUCK THE MMPR, it is a total scam at this point, Dr's are doing what they please walking all over un educated patients. I am most likly going to expose a group of Dr's real soon for some bullshit they are trying to pull on me.
I went 3 weeks as of this coming up Tuesday to a well known cannabis clinic in Ontario, it was the worst Dr experience I have ever had in my life and it is still on going 3 weeks later.
First the Dr is sitting in his chair slouched back with his belly hanging out, he then proceeds to read my file in front of him then he says "so it is your right shoulder?" I said does it not say left on your paper? he says oh your right(like wtf), he then goes on to ask me about my PTSD, before I got one sentence out of my mouth he says, I will give you 3 grams a day at 20% THC, so I said to him, I have been using cannabis for over 20 years medicinally and I have found that "Pink Kush" works best for me out of the strains that are offered in the MMPR, I told him that the PK comes in at around 26%, I also told him I use 4-7 grams a day(anyone who knows me, knows this is not a stretch) He tells me" WOW that is WAYYYY to much" I told him over 20 plus years I have built up a tolerance. He then tells me the only way i can get what I need is to come back and see the head Dr of that clinic, then he says or you can take what I am offering, so I told him " I will take what your offering plus I want to see the head Dr.

This is when the story gets really fucked up, so I go into the lobby to make an appointment to see the "head Dr" so I ask them to send me papers to Canna Farms and book my app, the girl all of a sudden looks at me and says "we can not send your paper work to Canna Farms" I ask her why she tells me oh we send all our clients to our selected LP's so I said to her in your orientation your head Dr stated I can pick what ever LP that is HC approved. She proceeds to ignore me and tells me about "Med Releaf" she said I should look at their strains, i told her I was with them in the past and was not happy, so then she says well they are with a grower out of Israel and that they have better stuff now, so I say still it is my choice and I do not want them. So then I ask for a copy of my script I told her in the past I have always gotten a copy of my MMPR script because when I travel in Canada it looks more legit to have the script and the prescribed bottle, she then tells me "sorry no can do, you might go to a dispensary with it" so I ask her what is stopping me from going once I get my LP bottle anyways? as this is happening all of a sudden some dude gets up and tries to fight me in the Dr's office, he calls me a brat for asking to meany questions then I tell him to mind his business, he says I am making this y business, the 3 girls who are talking to me then proceed to tell this guy thank you and they 4 of them ganged up on me, seeing as I suffer from PTSD from a few traumatic experience this was sending me into panic mode, it sent my blood pressure way up, it brought out really bad emotions in me. So the girl tells me to leave and she will call me in no more then 2 days with my script for my LP of my choice and with a date to see the Dr. 3 weeks later and not a call or anything from them, I am wondering if this is a violation of my human rights seeing as they prescribed my my meds and then are now with holding them for not liking me and my questions. Anyone want to chime in

PS Hippy I know what your going to say about LP's and the MMPR but I just want some down to earth answers on this one, should I be going to the collage of physicians of Ontario? Should I get a lawyer? any thoughts?

WHY EVEN BOTHER WITH A DOCTOR at all?
You dont need one.
If you get charged just like anyone else...you get off in court if you have an illness.
As things stand...EVERYONE can get fined and sent to court!

That's shitty man. When I went to a doc in Vernon I just brought my expired MMAR paper work. He said 20 grams again? I said yes, he signed after some questions. He gave me a list of LP's (there were only like 10 back then) and even had one listed as having their license pulled. Didn't recommend any one. Paid him $250 and off I went.

Wait for the big announcement, the rules are changing again 30 days. The mmar is dead, the mmpr is unconstitutional, HC is on crack.... and we are like fleas on a dogs tail.

Do what you need too do, First thing you should do is stay away from the Lousy Producers. their business is to make money NOT make you healthy. HC is going to try to say anything over 2 grams a day is excessive and should only be allowed in special circumstances (on their web site / releases). Find a grower who cares is your best bet. Monsanto vs mom & pop... who would you trust ???

If your job is safety related - piss tests - a doctors paper does not help. If it is not safety sensitive then it is none of their concern.

I wonder if there will be limits on Rec MJ? I know you can purchase one hell of a lot of booze before you need the licence thingy for parties, weddings...etc. Kinda hard to limit MMJ use, when we can buy keggers from the Beer Store!
