This is a sticky situation depending on where you live.In smaller towns they will crusify you and even if they catch you by the plants they will do thier best to get you with a growing with intention to sell and deliver a controlled substance plus a charge for ilegal cultivation on punlically funded lands.If its a more laid back are you might just make the police harassment list and be fucked with for couple years.Depends on the prosecutor and the county.I know people who lost cars, houses and property and had no weed thier.The got them on here say or ahveing cash over 10000 us dollars with out having it reported and listed with the government. Sounds screwed up but if you travel with over $9999 or have it in possesion without reporting and getting a cash posseion permit then can yank it an all property on suspision of illegal activity.Then you have to prove via paper work every cent or its all forfited.And I had it done to me before thanks to some fuck nut Texas yocal cop I happened to pass by on a round trip through that state.

it would definatly give probable cause. the next thing that would be considerd is your record . if youve never in your life been in trouble the bird story might work.but if you have a record (felony/misdemeanor) you might as well save the bird storie for the jury. peace

if you're "caught" looking at plants you're not going to jail unless you say something stupid. possession and cultivation - never heard or seen an "observation" charge....

google will help you find tons of case law. there was a case down here where a guy had his cultivation charge dropped because even though they have video evidence of him collecting bud he never disturbed or altered the soil - no cultivation. now, i will say that he did get a felony possession for his garbage bag full of weed but no cultivation.
