but the roadside MJ test does not say you are high. It says you have been high

It is not illegal to get high. Only to be under the influence in public (hard to prove) or to posses marijuana (easy to prove).

If a cop busted through my door on unrelated charges and I was blowing a cloud of marijuana smoke out of my mouth as he was entering I'm pretty sure I could get charged with something, even if I had ate the marijuana and changed the bowl into a coaster with my magic wand.
