ccw

i am considering getting my ccw and a pistol with my income tax and was wondering if any of you have yours and if you have had any problems having the pistol and mmj card?? i read through the state site and very possibly over looked the section about firearms so i figured id ask around here

I have my CCW - Got my doctor's rec back in Nov but no card yet... I highly doubt it matters. (No denial letter either)

I have both never had any problems but never had to show both cards at the same time.

as far as im aware from listening to ppl on here SOME states in the U.S. its illegal to be a licensed firearms owner/holder if you are a MMJ cardholder

I would recommend you talk to an attorney before making your decision, as this is a touchy subject.
In order to obtain a CCW you need to fill out the federal ATF form 4470, or 4473, I cant remember which. This form specifically asks if you use or possess any illegal drugs listed in section 102 of the controlled substances act. Since federal law still lists marijuana as an illegal drug, you must answer yes to this question. There is no way to purchase a gun or obtain a ccw without perjuring oneself. Lying on a federal document is a felony and is punishable up to 5 years in prison.
Many argue that we are in violation of federal law everyday, but we are legal under state law. So how should this be any different. As it stands however, anyone in possession of marijuana, whether medical or not, is in violation of the federal 1968 gun control act.
I know I dont want to be the test case.

IMHO the two card should be given out at the same time. I have both cards and I could care less. I'm not doing anything illegal with either card so why would carrying your meds and protection be illegal. Like my boy Ice Cube said "I rather be judged by twelve than carried by six".

I'd definitely agree with your sentiment, as I feel the same. However you must realize that the law does not. You are in fact breaking federal law by simply possessing a firearm and a controlled substance. The gun control act specifically states this. While I certainly do not agree, that does not change the fact that you are in violation of a federal law.

Here in the State of Washington you can be a medical marijuana patient and have a carry permit under "state law" but not posses a firearm under "federal law". Since when you go buy a firearm you fill out the N.I.C.S. "N.I.C.S. is run by the F.B.I. there fore federal" transaction paperwork it asks if you are a user of any illegal substances including marijuana (paraphrased). So as a law abiding patient I can go get a c.c.w. no problem and I could even go buy a pistol but when I check no on the NICS for that says I am not using any "illegal substances" then you break the law (fraud I imagine of falsifying a government document). F*CKED Up I know.

This is currently being contested in the Supreme Court. There are 2 cases going on right now that I am aware of one in OR and one in WA.

I guess you will have to ask your self do you really feel like you need a gun to be safe, if so why not re-evaluate your situation and make some other changes first.
I really couldn't give a shit about owning a gun personally but I don't want my personal freedoms and my rights as an American to be shit on for being an otherwise law abiding American citizen just because my medicine is not approved by the U.S. Dept of Justice.

Get your CCW first, then your medical card. That way you won't be lying to the feds about controlled substances. I wouldn't carry both weed and a gun at the same time though, just to be on the safe side of the law.

I have both and no issues but also havent been pulled over while having both on me. I want to be safe no matter where I go and pistol doesnt leave my side just my 2 cents

I agree with sheapdog420.

I only said that because if a cop pulls you over and you have both weed and a gun, he's going to be a prick about it. No matter how legal you are. I have my CCW more as a political point, and whenever I go to Detroit. I know that 99.999% of the CCW owners are honest citizens that hope to never have to use their weapons. I also think that 99% of MMMA patients got their permits to stop being hassled by their government. I mean, who really thinks they should have to pay $100 every year just to be legal to grow? This is America.

Cops know when they pull you over if you are a CCW holder. My father was pulled over for something trivial, and he didn't have his gun. The cop came up and got his license and ran the information. When he was coming back to the vehicle, he had his gun drawn, and was standing in a very defensive manner. He stood back from the window and asked if he was a CCW holder and if he was carrying. My dad said no and things calmed down. The cop explained that if you are a CCW holder, they would appreciate us citizens being up-front about the situation, and keep your hands on the wheel where they can see them. I can't blame the cops, if I were one I would react the same way. But bottom line is that CCW and MMMA permit holders are not viewed upon favorably by law enforcement, regardless of our legality. Don't give them a double reason for f-ing you over. Besides, if you are legal, and you are delivering, chances are you know the person well enough to know whether you need the gun or not. I wouldn't care-give to anyone I felt that I would need a gun.

This works only if you already own a firearm. If you smoke pot and buy a firearm you have commited perjury. Firearms are covered by the feds.

i have both and both cards, i have yet to be pulled over with both, but i assume with proper discretion he wont even know about the herb. so i wont have to tell him. i dont ever leave my firearm behind.

I never leave with home with out my CCW permit and gun, but I almost never carry med's (or my MM card) when I leave the house,....

and I never actually conceal my weapon (unless it is so cold I have no choice but wear a jacket).


Open-carry your weapon and you don't technically need a CCW (unless in your car or a PFZ).

Even without your CCW this state affords you the right to bear arms, if you follow the laws. I carried everywhere I went for 2 or 3 months before I received my CCW. The CCW makes it a lot easier to open-carry, but I have no plans/intention of concealing my weapon.

Thanks all I think im gonna hold off until I speak with an attorney although I dont see me getting pulled over with both on me at the same time Id rather not lie to the feds and have it come back to bite me later in life
