Default What Is A Co-op And Is It Legal In Michigan
I was trying to get my head around what exactly a co-op is and how it could work in Michigan.

Under proposal 1 which goes into effect in April, only a care giver can sell to his or her registered patient. All other marijuana sales are still illegal. For example: if the police raided a dealer's house while a patient was filling his prescription, the patient would be in legal possession and the dealer would be arrested. Even if you choose to wait until you have a prescription to start growing you have no legal means to start the process - to get seeds or clones or dried cannabis which you can legally poses. It's really set up to feed the black market....but I digress.

Does a co-op allow you to trade seeds and clones and bud, but pay some sort of fee to the co-op?

Yes it does, if you have a permit you can legally buy bud, plants, or seeds, off of the black market. A lot of sites may inform you that this is still illegal, but it will not be, check the Michigan Department of Community Health website if you do not believe me (http://www.michigan.gov/mdch/) You do have to pay an annual fee, which Michigan has not set up yet, it will be in the $100-$200 price range.

I'm about 20 minutes from detroit and I've been reading up on medical marijuana and how I could get a permit, if you have any more questions, comments, concerns about MMMA (Michigan Medical marijuana Association) feel free to shoot me a pm, I'm getting pretty sharp on ways to obtain them.

Thanks for the feedback - I will be in touch in PM. I had searched the health site before and never found much. I was getting the impression that the health department was facilitating as little as possible.

I started another thread a while back without much feedback. There is a link on my last post that goes to the full details of the care giver previsions and I didn't see anything in there that would let you legally obtain plants or seeds - including or excluding buying dried bud.

I stand corrected. I followed the link to the health department and they have a posted PDF on the homepage. I hadn't seen that before, not sure when they posted it. I will be reading through it and posting it back here.

OK - I read through it and it pretty short - just an FAQ. It doesn't give any new information. In fact, it gives deceivingly little information. However, the last two questions and answers touch on this subject.

I believe there is also a prevision in the full text that states if you sell marijuana to some one other than your patient or have a drug conviction, you can't become or remain a care giver.

So, if I don't grow I can legally start to grow but I have to break the law to start to grow legally which means I can't grow legally............insert a picture of a dog chasing it's tail.

Four - I have a couple of follow up questions. I wanted to post it here and share if you know the answer rather than PM. The questions are in regards to the legal limits of plants (12 per patient) and dried material (2.5 ounces per patient).

Is there a time constraint related to the total limit? For example: I am a care giver with two patients. I drop 2.5 ounces off to both patients on the first day of the month. Patient A is a light smoker and doesn't consume Cannabis any other way. By the end of the month, Patient A is only requesting another 1/2 ounce. Patient B on the other hand is a heavy smoker and loves his brownies. Within 5 days he is requesting another 2.5 ounces. Another request 5 days later and so on until the end of the month. Now if the police check either patient's home in course of the month they would have only found 2.5 ounces which is the legal limit, however, Patient A went through 1/2 an ounce while Patient B went through 12 ounces. Are the police or local prosecutor going to have a problem with the overall quantity over a given period of time?

The second question is whether or not the limit is cumulative between the patient and care giver. As a care giver do I have to keep track of much my patient is consuming on a daily basis and match my material on hand? In other words, if the police came to my home and the patient's home at the same time in a coordinated effort, would there only be 2.5 ounces allowed for the patient between the two of us.

I checked out the 3MA site and found it really helpful. Here is their take on the care givers (http://www.michiganmedicalmarijuana.org/node/13), but it doesn't really answer my questions. I signed up for an account and am awaiting approval. I would definitely be interested in learning more on finding or starting a local chapter.

Sorry I haven't been able to get on lately, I am on that site too! I'm trying to find something around my area also. I'm unsure about your questions, I don't think they have established fine details of all of that yet. If I hear anything new I'll let you know though.

Not a problem, I have some questions posted there as well. It sounds like a lot of things aren't definitive and won't be until somebody is arrested and tried. My concern is that all of this periphery stuff like getting seeds, clones, etc... is not explicitly defined. LEO will simply arrest and let the courts sort it out.
