The Palm Springs City Council Wednesday will discuss a draft ordinance that would allow marijuana dispensaries that comply with guidelines set by California state Attorney General Jerry Brown issued in August.

The ordinance, which would prohibit for-profit dispensaries in Palm Springs, would allow dispensaries organized as non-profit collectives or cooperatives but confine them to areas zoned for industrial use.

Under the ordinance, dispensaries would have to be located at least 500 yards from schools, public parks, playgrounds and residential areas.

In August, Brown said that formal cooperatives registered under the state's Food and Agricultural Code or organized as less formal "collectives" are legal under California's medical marijuana laws.

But Brown said that anyone running a for-profit storefront dispensary not operating as either a registered cooperative or collective may be arrested and prosecuted by local authorities.

Palm Springs City Attorney Doug Holland has said that enforcing state guidelines and limiting dispensaries to industrial zones should keep too many from opening in Palm Springs.

The City Council is expected to refer the draft ordinance to the city's Planning Commission at Wednesday's meeting, which starts at 6 p.m.

This is such good news for an area of CA that has been so ruff on MJ patients. Hopefully this will get some other surrounding cities on the board.
