| | glove box question | | hey guys first post!
just wondering what the laws are concerning locked glove boxes: can cops search them, do they have to have a warrant or probable cause?

Or if you give them probable cause, like saying don't look in the trunk, or say lock the glove box while he is beside you or they can see any paraphernalia. But what i did when i smoked in cars was if a cop rolled up, I would tell everyone to get out, hide everything, and lock the doors the cops cant search you or your car if you just are going for a walk. Remember your innocent until the prove your guilty.

This person is simply wrong. In general the cops dont need a warrant for anything in your car that you can reach. The courts take that to mean pretty much the entire passenger compartment. A glove box does not require a warrant. You stated that the glove box was locked, which would mean you couldnt reach in there, and therefore a warrant would be necessary.
Having said that, if they are placing you under arrest for something else or towing your car, they can search the entire thing for inventory purposes. Basically they can get around the warrent if they really want to.
Ignore the advise above. Jumping out of the car will just give the cops reasonable suspicion. Even if you are all out of the car, and you were recent occupants, they can search the car. There is a supreme court case on the matter.
In general, pretty much everything the above post says is wrong or highly inaccurate. My advice. Be polite. Say good evening officer. Oh i was speeding. Here is my driver license and my insurance information. No i will not consent to a search because i dont believe in that. I am leaving now. i would like my license and my insurance info back and i am not waiting for a drug dog.
Try to pull some tuck and roll and you will be in handcuffs with the same pig who posted the above shit laughing at you. |

| | Well whoever the fuck said I am wrong obviosly you have never had an encounter with a cop in Canada. I did this over fifty times in one month, and they can't do shit. Mind you you can't be moving just sitting in the car kinda thing. Like beside a park or in a lot. I also have been caught up and they arrested me and did search my car, and they found weed. I went to court and did not get charged with anything, do you no why. Because, In Canada anti-Pot laws are currently unconstitutional. ThePotLawHasFallen.ca. And the fuckhead who was fucking bashing me because he thinks hes right can just fuck off, and only say shit politley unless you know the fucking situation. Do you know for a fact this guy was talking about while driving, I guess I was wrong when I spoke cause he was driving, but you don't gotta be so fucking negative. The reason I get to swear at you is cause you called me a fuckhead with out knowing what I was talking about.

Furthermore, when you are talking about Canadian law, you should state taht in your response being that its a different country. If i responded with dutch law, where cops cant even search my car, dont you think it would be relevant for me to say that?
Anyway, i was having a bad day so i apologize for correcting you in a rude manner.
Also the website you cited, however helpful and persuasive is not binding on any canadian court. Meaning not all canadian judges intrepret the candian constitution the same way.

| | No they need a warrant to search your glove box or your car unless something is in plain sight like a pipe, roach, ect. Often if you decline a search its a red flag and if the cop wants to the may call k9 units. They don't need a warrant to have a k9 walk around the outside of your car. If the dog alerts then the have probable cause to search the inside of your car. So best advice don't drive around with lots of weed. |

thanks guys | However, if you reach in to get your proof of insurance and they spot anything, you are fucked where you sit. Leave anything the copper would ask for under your windshield visor so you can leave the glove box unmolested during a stop.
