Well i was walking around because it was such a nice fucking day, and i see cops roaming around every were and helicopter flying po pos in the sky but yea one rolls up to me and says well the normal. people have been calling in saying "I" looked like the guy they were looking for an shit but anyway the mother fucker searchs me and he dfinds my pipe so am like fuck because i have a record already and if i get charged with anything i will have to go to the pen for 2 years because of my pre-CHARGES so i have to show up in court on the 10th of this month. i plan on trying to get my system clean and jus say it was not mine get a drug test and bam hoping this will work but yea, tell me what you guys think give me advice please its only a M of the 4th degree i live in ohio.

i live in ohio and got caught with ap pipe they tried to take back my grants because of it plus take my dl for something like 6 month. I got a good lawyer and got rid of the charge

Well guys say my po today and droped dirty!! i bought this shit from a head shop near by for 30 bucks and they said they say it in my urine. WTF!!!Now i am fucked going back to be a jail bird ...

You might have a shot at getting the charges dropped due to illegal search and seizure.

As far as I know, cops are allowed to pat down anyone they want to check for weapons. If they don't feel a weapon, they cannot search you. It would be hard for a cop to mistake a weed pipe for a weapon. Therefore if he was doing a pat down for weapons he did not have the right to escalate the search into emptying your pockets etc.

And this stuff about you looking like the person they were searching for... What ever happened with that? Did the cop just say after he searched you and wrote you your weed ticket, "I guess you're not the one we were looking for, have a nice day" ... If you being a suspect in another crime was the foundation for the search of your person, the "fruits" of the search may only be as valid as its foundation, which in this case is shakier than a bag of shake. I'd take this to trial or at least be ready to when it comes to pre-trial negotiations... try to get a nice deal with no jail time ... remember, maintain your innocence and appeal to your rights as a United States citizen protected by the constitution, specifically the gauranteed protection from illegal search and seizure.

No it was bullshit i just got a lawyer i have to pay him 1200 for the case and the cops did say they wanted to pat me down for weapons but i dont know if that will hold up in court but maybe. and the guys hey were looking for were 2 black guys that robbed a white dude at gun point and they said i fit the discription AM FUCKING WHITE!!!
