Keep in mind that SWIM is a white rich kid that gets good grades etc and this is his 1st offense. If all of the weed was in one bag can they still charge SWIM with intent to distribute because of the other empty dimebags?
No, a good laywer would argue that off easy. But if there was even more than two, ie, three. It changes stuff. Now with that said what was he charged with. If he does not have charges he is either a rat or a lucky kid. If they hooked him up, took him downtown, he has charges. They dont release you after you are in without charges.

SWIM was taken to the station and had his parents called and information written down. SWIM was not handcuffed nor told his rights. SWIM was also not told he was being charged just that he would receive a letter with a court date.
Were the dime bags new/empty, or used/empty?? If they were new/empty then you'll have nearly no chance arguing against intent to sell.. If they were used/empty then a decent lawyer 'might' be able to keep things a matter of possession.. I don't know anything about NJ either way, but I'd rather be in your shoes than alot of others who post scenarios here..SWIY though has obviously not been afforded their right to a quick and speedy trial because given Rollitip's TOS this obviously must have occurred atleast 13 months ago..

first offense, conditional discharge, no probitaion, nada... you should walk, but have to pay heavy fines..
make your one and only conditional discharge worth it though.. it sucks using it on something shitty..
