Seems Texas doesn't have anything for plants in particular. Some states do, and they would classify growing as intent to distribute or trafficking, which typically carries a hefty penalty. Even selling 7grams- 5lbs in TX only gets you up to 2 years. In some neighboring states, it is much worse.

Unfortunately it is still illegal in Texas. You can't take the law to critical they rarely hand out maximum penalty's. They usually work out plea bargins. With that being said the weight of the smokable material would be less than 4 oz. He stated to the law official during the time of the bust that he uses marijuana for medical purpose only and he would be violating his constitutional rights to his medicine. He has hired a lawyer one of the best money can buy in this small town. Thanks for all the help from everyone even the early birds.

going through texas years ago me and a buddy were hitchin a ride 2am pulled over on the interstate guy that picked us up freegin wierd get out pisses on his feet cop sits him down asks our names blah blah finds a seed and thats it driver gets slammed into back of cops car .cop tells me follow him to police station asked if guy had any more pot im like u found a seed long story short the guy had 4 days prior stabbed the lady who owned the car stole her checks wrote a bunch and stole the car... so even if weeds illegal in texas at that point in time i was glad (and the only time) cop had to give some one a hard time

I know they can charge you with a pound a plant here atleast outdoor not to sure about indoor
