Default Legal vs Reality
I've been doing some reading lately on my legal rights. I haven't been pulled over in over a year, but when I was in the past I always allowed the police to search my car. I knew for a fact I had nothing in my car (well a seed\stem once). The same cop who found the seed\stem actually let me go after letting him willingly serach my car.

Every thing I've been reading recommends always calmly asserting your rights and never letting the police search\question you. Watch "Never talk to police" by "Justice Jackson." It is a speech by a law professor and cop to a class. I'm going to refuse the search next time to see what happens.

-Will refusing the search usually result in a ticket for SOMETHING?

-Is it better to hide "stuff" deeply in the car and let the officer search the car, or should I ALWAYS refuse?

-Will most cops threaten to use dogs if I refuse? Even if I have no reasonable suspicion I had marijuana. Will they lie?

-What if they threaten to use dogs. Is it better to allow a search w\o the dogs (with stuff hidden deep), or risk having the dogs find my stuff, which they will.

-What are the chances of a lawyer getting the case dropped if I assert all my rights (i.e. I refuse a search, the officer calls in the dogs, but I never gave one hint of reasonable suspicion). Won't cops just lie in court?

Now relating to Terry Stops (stop and frisk), I have been getting mixed information regarding "plain feel."

-If I never gave reasonable suspicion that I have WEAPONS on me and I refuse a Terry Search, but weed is pulled from my pocket, will a lawyer be able to get me off?

-Can officers sieze contraband in a Terry Search by "plain feel." If so, I can't identify a 5-bag in a pocket by plain feel alone. That lump can be a crumpled paper or money or lint.

-What is the best thing to do if asked to be frisked and I have marijuana?

-Do most cops lie about reasonable suspicion?

In reality, is it better to assert my rights no matter what, or let the police do their thing?

EDIT: I live in Florida. Pretty strict marijuana laws.

they will just get a warrent or find another way to get that search done(i think you look high, i smell burnt marijuana or alchohal ect.) but if you got nothin in yer car give it a try and see what happens

Why does EVERY defense lawyer\article on the internet recommend asserting your rights then?

Anyone else??

im not an expert just been arrested a lot of times, but i would say its because the cops are sneaky crooked bitches they walk a thin line between right and wrong if a cop says he has a reason than he has a reason
