Question Can u get busted jst for light?
I've been reviewing many of the laws on Norml and Flex your rights. However, they are not exactly that clear. Can a lit basement or bedroom be seen as probable cause to enter? What happens if someone snitches on you? Why should the police believe a rumor without hard evidence? I hate when i read,
"If you have been charged with a crime and you feel that the evidence was illegally obtained, your lawyer can make a "motion to suppress" in which the judge will consider the manner in which the evidence was obtained and make a decision as to whether or not it can be presented during the trial." So basically you have to hope that a judge sees things your way. All opinions welcome. Thanks.

"Cops raid house to find Christmas trees under grow lights: Where's the probable cause now?". Ha, some ex cop set up a fake grow to see if his rental place would get raided. I don't know how to post links but if you go on a search engine and put in, "Cops raid house and find Christmas trees" you should find it. The place was full of web streaming cameras and the only person there was a lawyer whom they arrested. They also refused to show the search warrant.

Having a medical recommendation won't keep you from being arrested, but if you're charged in on the state level then you can use it as a defense at your trial (assuming you live in a state that allows medical use).

For the most part, despite the whole "innocent until proven guilty thing", it is usually the other way around. You're guilty until you (and by you I mean your expensive legal representation) can prove your innocence.

It's also not illegal for LEO to use FLIR technology, but typically they must have a warrant first (which isn't hard to get.. these guys work with the judicial system every day, they know how to get a warrant even if it means lying and covering it up later). Sure, not all LEO will use unethical means to obtain warrants, but it does happen. We've (and when I say "we", I really mean our gov't, not the people) given the police way too much power, and they abuse it all too often at the expense of decent people. Information from an "informant" has to be corroborated somehow, either by another witness or LEO's own observations which could be entirely made-up (smelling cannabis growing from outside your home, evidence put out in your trash, etc). In most places the police can enter your home without a warrant if they have probable cause to believe a crime is being committed at that moment in time. You read a lot of stories in the news about people who were growing cannabis and got busted because someone tried to rob them and they (or a "helpful" neighbor) called the police. There's the occassional house fire story with the plants being discovered by firefighters, too. If you read enough of these stories you'll notice that the big busts mention infrared or thermal imaging more often, whereas smaller grows are usually discovered by accident.

The best solution is to use all available means to circumvent the prying eyes of LEO. This means being smart about how you grow, and not making easily avoidable mistakes that could get you busted. If you're worried about being spotted by infrared, then takes measures to make sure they can't see you (proper insulation, heat diffusion, etc).

DoobnVa- I agree with you, i intend to buy a grow tent. I'm not using any type of serious (HID) lighting so there's no heat. I jst wanted to check responses and see if Johnny law can kick down my door for lights being on in my house. So far I'm positive they can do whatever they want. Peace

I think they would have to have more than just "lights on in the house"... but your right, they pretty much do whatever they want.
