i got a poss. of marijuana charge.
it was 11 months ago.
last po visit on the 6th. then court next month.
got a diversion program..
so, heres my question.
is it off my record now??
or when i get off probation?
gotta backround check tom 4 a new good job.....

You probably have to go to walk in court and ask the judge.

Yea it shouldn't go on your record. I had to go through diversion court before for assault, and actually had to have a background check to get a job that I was applying for and it never came up. So you should be good.

If you weren't convicted, then it shouldn't show up on a background check. That all depends on how they do their background checks, though. Where I live, they put all the court records online for anyone to see so in theory someone could find a charge that was dismissed or nollo prosequi if they do in-house background checks this way. If you haven't been back to court and the judge hasn't dismissed the charges contingent on your finishing the diversion program, then there's a chance that it might come up on a background check as a pending charge, but again that depends on what kind of background checks they do.

i called my p.o. and she said it is on my record. that really sucks bcause they job hasnt called me back yet. i passed the drug test tho.... i used my boys piss. i was scared the temp only went to 92 degrees. but she didnt even look at the temp!
