Illegal Arrest: KNOW YOUR RIGHTS
“An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260).
You don’t have to run when resisting an illegal arrest:
“When a person, being without fault, is in a place where he has a right
to be, is violently assaulted, he may, without retreating, repel by
force, and if, in the reasonable exercise of his right of self defense,
his assailant is killed, he is justified.” (Runyan v. State, 57 Ind. 80;
Miller v. State, 74 Ind. 1).
If you see someone being arrested illegally, you have the right to:
“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910).
Up to the point of:
“Citizens may resist unlawful arrest to the point of taking an arresting officer’s life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529.

yea you might be right as far as thise cases and hearings go but you know as well as everyone else that cops can lie and easily get away with it. happened in my home town a couple of months ago, a man was killed by cops because he was "resisting" arrest but there were a number of witnesses and there testimonies went unnoticed. I agree with your thoughts on resisting illegal arrest but doing so might end you up in more trouble than origanally. cops have to much power for themselves, dont let cops push you around but dont let it cost your life for something simple.

My experience growing up in ghetto ass Long Beach, you do what the cops say and have your day in court to prove you're innocence. Even If they are In the wrong do not fight and do not resist, I have walked that path In my younger day's and It's the worst decision to make. Use your verbal skills and be respectful and I guarantee you will get the same back from them.

yes this is what I leanred too, you let the cops do what they want and you keep your mouth shut, then you can choose to fight it or not...
Ive also learned that if you dont act or talk retarded to cops and try to be all tough and shit, and you let them know that you are intelligent and know your rights and you can call em out on anything they didnt do right during the arrest, you can sorta make em feel dumb, while still being "respectful"...which is a big thing for cops, they need that respect, so give em fake respect, they have big false senses of authority.

Yep, I worked custody for a local Sheriff's department for 1 1/2 years so I know all the radio codes. Whenever I get pulled over I fuck with them and talk in code and they're like WTF, It's pretty funny.
