Let me start this off with a few facts.

I have posted this same post on a couple of other sites...

I live in Texas.
I have extreme anxiety and don't deal with cops very well.
I barely had 2 grams.
I had a small pipe(paraphernalia).
My car was towed.
I went to jail over night and bailed the next morning.

I obtained a court appointed lawyer.

I'd like to know what is going to happen when I go to court.
I'm pretty sure I'm going to get probation but does anyone have any ideas?

I'm extremely anxious about this all the time now, I'm just worried about what might happen.

I told my lawyer this, which is true... The doctor gave me an anti-depressant which i guess I was allergic to or something... I began puking daily, up to 7 times a day. I was smoking weed because it alleviated these side-effects.

I also told my lawyer I found the weed in a park which also had the pipe in the bag with it lol, hey, weird things happen.

I guess I just need to talk about it and just forget about it til I get a court date... Surely nothing big is going to come of this... What would the judge thing of me finding weed in a park?

My questions are serious though... I was worried about them coming to my house saying they have a warrant, I've even dreamed of such things happening. I just don't deal with cops... Nor should I have to! currently, even if they did, I have nothing.

Also, I've been pulled over since then. I don't think it was coincidence, I think they tend to be watching me. It was a state trooper both times.

Seriously, weed is the last thing you should be smoking. I dont know how u can handle it as you already sound very very paranoid. First off it WAS a coincidence, there not, i repeat NOT watching you. You got busted with less than 2 Grams, do you really honestly think that they are going to spend the time and money to follow you and have a surveillance team on your ass?Over two grams? Really?
And secondly there not going to get a warrent and kick down your door over TWO GRAMS! They honestly could give a fuck less about a small scale bust. Maybe if they cought you with 14 kilos of cocaine, but they didnt, they caught you with 2 measily grams of pot. Calm down and take a breather, your going to be Fine. What will happen in court (if your public defender isn't a complete moron) is you will get a diversion and have to attend drug awarness classes and probably a drug treatment program where they will piss test you any where from once a week to once a month. The drug treatment program will be out patient so dont worrie you wont e living with the crazies.

i live in mass so i dont know texas law, also when i got busted it was THE DAY people were voting to pass the decriminalization but.

it was my first drug related offense(amazingly)
i got caught in a car where the driver just got his license and couldn't drive after dark of something
all 3 people in the car had bags of weed except me(wonder where they got it from?)
i had a giant bowl (worth $75) a 4 chamber space case grinder (worth at least $50) with a few flakes of weed in it
i also payed $500 for a lawyer who specializes in clearing petty drug charges

i was on something like technical probation for 3 months and if i stayed out of trouble the case would be thrown out. it was and i stay out of stupid situations like that now. i lost over $100 prized possessions because i was too stupid to keep them safe.

my point is if your lawyer knows his shit and its your first offense you will probably walk clean or with a little probation

Well, you can't just make up some bullshit alabi.

Point being, you were caught with something illegal.

The cops found it on you, that is irrefutable evidence.

The judge is just going to say if you knew what was good for you, you would have left it in the park and not picked it up.

my son got poped last year , ask for deferd judification ,it will require drug testing ,at least 40hrs of community service, drug classes and a fine and court cost about 650 bucks or so ,what this does is drops the charge if you don't get into any more trouble for 6-9 mounts

Don't tell the judge you found the shit in a park. The judge will think you're just a lying dope fiend. Tell the judge the truth. You don't have to say HOW you got it because they don't care. Tell the judge that you've been to your doctor for anxiety medication and you were prescribed medicine that made you sick. Then tell the judge that you did research on the internet for things that would help the stomach upset and coincidentally marijuana was near the top of the search results.

Look into the judges eyes with respect and show a little fear, but don't be cocky and/or shifty. Be VERY expressive about your respect for the law and NEVER interrupt the judge, public defender, cop, or da. If the judge says something to you expressing his/her opinion, do not argue with the judge. In fact, avoid coming across to the judge as ANY kind of aggressive character. Do not throw your hands around if you are upset about something said. Be calm, listen, acknowledge, and don't make yourself out to be a liar.

I will say that Texas is a state with harsher laws regarding marijuana possession, but keep in mind... you only had 2 grams. Make sure your public defender knows that 2 grams is basically 3 joints. If the judge asks you why you had it with you while driving, tell him/her that you have someone at home who has strong feelings against drugs in general and you don't want to hurt that person. This will tell the judge that you have respect for other people and you're not a bad guy.

Before hand, ask your public defender if he/she can call a private session in the judge's chambers if the public defender doesn't feel like things are going smooth. It's unlikely that the judge will go for it, but if the judge does, your public defender can speak to the judge on your behalf and interject things you may not be able to think of when you're in front of the judge. Pressure is a bitch - it can cause you to do or say things you wouldn't normally do or say. That's why you have to say in the back of your mind REPEATEDLY "Whatever happens today will have no long term affect on my happiness!".

Ad these points.

- forget the found weed in park bs. I don't believe you and neither will the judge. Not a good way to talk to a judge. He will say you should have put it deep in the closest trashcan and be done with it if you found it. You didn't so you pay the price. Moving to next subject.

- Go completely over the story with your lawyer prior to the court appearance and don't surprise him because he is the only one that can support you to the judge.
First mention to the judge that you respect the law and understand that weed (called marijuana to the judge for respect) is against TEXAS State Laws. Mention your prescription for Axiety and how ill it makes you. Take a note from the doctor about it in some way and maybe take an empty bottle with you to court to show judge. Tell him with all your illness vomiting on the prescribed anxiety drugs you found yourself googling anxiety on the interet and ran across CALIFORNIA people who had great success with DOCTORs prescribed weed for the same type axiety. If you can find something on line about that take a copy of it in to court. Ask for the judge to be easy on you and you will continue to search for another prescribed drug to help your illness since weed has got you in this trouble. Mention if you were in Cali that you would be legally precribed this drug for axiety (respectfully not arogantly). Tell him you only use/used it rarely (so judge doesn't see you as a druggy) when your very stressed and make up something that made you stressed when busted (job, school, family illness etc.). Tell him you don't want to get in this type trouble again so you are looking back to the prescribed meds for help. Dress nice, look sharp, hair cut and don't use slang in any way. Act like it's a job interview. You are not looking to have this thrown out of court at this point b/c it won't happen in Texas. You are asking for the least possible outcome to your record/fines etc. Mention to the judge if you can have this strikin from your records for future employment concerns due to the small amount. Hopefully it's your first dealing with the law other then speeding tickets and you will get a fine etc...GL

Hope you learned your lesson not to take weed on the road with you? If you do only take a couple joints and put them down your pants so only a drug dog could smell/find them if pulled over and patted down by a cop.

youre going to be let off all charges on time served alone on possible probation. wich shouldnt even be probation you should get that lowered to a drug class or some bs. pay 50 dollars, and call it a day.

oh ya u need money to bail out ride from the city, probly 100 bucks, better get it out quick, cause the daily charges are gonna stack up on you. dont call and ask them specifically about the charges, ask how much to get it out of the yard, and get the persons name you talked to before you go to get your car.

the most extreme is the paraphenelia charge, it sucks to have that on your rec but if your can get it expunged or whatever thats called, from your lawyer, on some basis, as you were on your way to the hosp[ital after you purchased a sack or somethin.

but even then who cares doesnt president ob and others have some kind of drug charge too haha...
