Default Off-property legal issues (midwest)
I asked this in the newbie forum and, though people have supplied grow advice, they didn't really answer my legal question so I'm going to try it here. I have a large backyard but no privacy fence, so growing in my own yard is not an option. The wife doesn't want an indoor grow, so that is also out. Behind my property is a chain-link fence and then a rather large (about 10' deep), overgrown ditch with a small stream. Beyond that is the highway. I believe I can hide the plants rather well within the scrub, trees and greenery (it gets very overgrown very quickly), but I'm wondering about the what ifs...as in what if my two little plants are discovered? The area is relatively accessible (meaning it's quite reasonable that someone other than me might have planted them, though people don't tend to stroll along highways) and they often find random grows on public land around here with relatively few people busts. Has anyone had experience with such a situation? I like this location because I can still get the plants water when summer comes along and it *seems* like, if they're discovered, they wouldn't be traceable back to me. Would this supply probable cause for officers to search my home or the homes of my neighbors? I will, of course, garden only in the very early morning, use gloves and alternate my path over the fence and to the plants. Additionally, we're only talking about two plants here.

Take special precaution of trails.. Its not really a question about legalities, its a question of stealth.. You might find yourself in grief if some kids were to plant like idiots back there.. They would need some way to tie it to you to get a conviction, and they know which cases they can win, and drop the others.. Or they may not suspect you if its found, and ask you to keep an eye out for kids.. Its a craps shoot..
Ditches are great though.. Nobody looks at them closely, so if you're smart, and not greedy its as low risk as outdoor growing gets assuming you don't stand out like a sore thumb in that ditch if its a busy highway 24/7.. You'll have opportunity to keep an eye out for busts (not that I'd expect that growing sparsely in a ditch)..
Put it like this.. If I was on a jury, there is NO WAY I'd pin that on you beyond a reasonable doubt without proof.. It sounds like an absolutely publically accessable place that no public will care to bother accessing..
My dad grows in ditches like that.. He doesn't even try to hide them, just lets the odd sativaish plant grow towards the sky, and he's never had one found.. Trick is sparsity, no plots of any kind at all.. Make it look as close to 'ditch weed' as possible until after you harvest..

Awesome. Thanks much for the advice. They're going in the ground this weekend. I need to find some type of mask, though, as one of the best spots back there is smack in the middle of some serious poison ivy! It isn't that I'm trying to hide it there or anything (though that might help deter the deer, I hope), just simply that the sun shines almost all day on that patch.
