Can Leo, DEA, any other guv'ment entity use my posts or pics against me as evidence?

I really want to post pics on here to get the best advice from experienced growers, but my grow-partner/roommate is having serious hang-ups about posting pictures.

I told him that he was being paranoid and that the fuzz has better stuff to do with their time than parooze forums. But as far as specifics go, can yall point me to anything that would put his mind at rest so I can use this forum for it's intended purpose?

Additionally, can "the man" track IP address/proxies/cookies through this site or any pictures you post?

Yes. They can trace your IP.
Yes they can use it against you.
Yes they can put you in jail for a long time.

What can you do?
Make it so they cannot trace your IP with an anonymous proxy server

Personally, I don't bother with it. Feds sure as hell are not looking for someone who grows for personal.
There's no money in it. Local cops don't bother either. They are looking for suppliers.

I think along the same lines as Cruzer. If you are growing a forest, then being careful is the name of the game. If you have one or two plants, or a medical card (and are staying within the appropriate guidelines) then there is just not enough to make you a good target.

I am sure that LE cruises the forums once in a while. For that, the amount of work that would be required to sort out the big time growers, the personal use growers and the MMJ's would be astronimical. I would think that they have higher priorities.

The police/feds cant trace your IP address from this site, and they cant use anything against you unless they know it is you, which they will not if you keep your identity a secret as you should be.

Also, you may watch all these crazy shows that make you believe the government can watch your computer, all they need is your IP.

Not true, You're IP is just a identifier. Which they DO NOT have/can get access too without access to the server.

In order to get access to the server, they need a court subpoena. Pictures, grow tutorials, are not considered admissible evidence in any circumstance as possessing pictures of marijuana is NOT a crime, posting pictures is NOT a crime. No judge would sign a court subpoena because they want to find out who is posting those pictures. Oh, and a judge can only administer a court subpoena for someone in there jurisdiction.. Therefor if they do not know where you are from.. They cannot even proceed to attempt to get a court subpoena. Mind you, they will first request the information and MOST webmasters will hand it over as getting a court subpoena is difficult and time consuming

Oh, and if they do receive an IP.. They will need to go the ISP to find out who the IP belonged too in that time frame. ISP's always require a state/provincial/federal order and will not give out information at anyones request.

Then, if they go threw all this process.. All they have that SOMEONE at your address posted legal pictures of marijuana, tutorials for growing marijuana, etc. None of these are crimes in North America therefor they could NOT recieve a search warrant based off this information.

HOWEVER they COULD use this to strengthen a case already brought against you, IE they have a tip that you are growing marijuana (not even grounds) and that you are a frequent user of a marijuana website with the username "Barrett".

They find the username "Barratt" and his pictures, thus ADDING to a case which they may retain a search warrant.

I would say it doesn't matter what you do online here, as you're already fucked if they do use this. Same with them searching your garbage, checking hyrdo meters.

They already know, and you are already fucked.

Although, if you've already made yourself a target somehow, say by telling others about your grow, or giving LE hints to your grow then posting pics on forums about your grow can and will be used against you. It's nothing anymore to include in the warrant process a letter to your ISP to get log data... can be requested and released the same day as a matter of fact.

I know when I had an investigation on one of the forums I manage/co-own (sythe.org) regarding a member stealing tens of thousands of dollars.. I still did not give out information, as i'm not in the position to waive other peoples rights.

RIU sounds like a good dude, but in the end it's really up to him. I wouldn't be disappointed/surprised if he did.

LEO uses lies and deception to instigate fear which saves them A LOT of man hours. If you are concerned, do what I do as a matter of course. D/L a proxy server software system and surf through it. Like laundering money, goes in dirty but comes out clean. Right now my IP is coming out of China...
