I was busted for growing 6 plants in the closet of my room in my basement on 7-31-08. I was arrested and taken to jail only to be released pending a warrant the next day. Since then I have spoken to an attourney and he says until the warrant is issued I cant do anything because there are no charges against me. How long does it take to have charges filed against me and for them to get an arrest warrant? I live in Missouri.

Depends on how busy they are. 1 month 2,6,8

If you're looking at a misdemeanor charge, most states allow around 6 months for the warrant to be filed.

If you're looking at a felony charge, it could take a year or more.

The police and courts move at their own pace.

On the other hand, it could take as little as an hour for a judge to sign a warrant. Given that you were caught "red-handed" at what most likely is a misdemeanor, I doubt they'll involve a Grand Jury.

Compared to many of the other grow rooms listed here yours seems rather small. How did you get caught? Are they going to take your home (asset seizure/forfeiture)?

did they issue you a ticket? a court summons? usually if they take you in then youll get it right when you leave. thats how it usually works at least
