Exclamation colorado caregiver laws?
Ok, so I have my medical license, and was wondering about getting a care-giver, I wanted to have my friend as my caregiver since he owns the place that he lives in and I live in an apartment, however he does not have a medical marijuana license and is not a patient, I was reading up on the laws and I didn't find anywhere that said you have to be a medical marijuana patient to be a caregiver in colorado, but the doctors told me that you have to have a license to be a caregiver and then suggested that I make the dispensary (which is in connection to the doctor that recommended my use of medical marijuana) my caregiver.
So I was wondering if that was at all the case or if I could find some random joe on the street and make them my caregiver, assuming I trusted them?

I realize this is supposed to go in the legal/medical marijuana forum but no one is viewing those.

Anyone above the age of 18 can be your caregiver. Even your mother.

In Colorado right now, this is a very gray area.

As I recall ( I haven't looked into it in a while), there are NO laws stating that you can sell dope yet, with or without a piece of paper saying anything. In fact, within the last two months, several Colorado caregivers and dispensary's were temporarily closed and product confiscated by local law enforcement.

There was an article last week written by a guy in Westminster Colorado about him becoming a caregiver, and now opening a dispensary. When he became a caregiver first, he made a point to meet the sheriff and talk to him in length about his operation. Being on good terms with the Sheriff prompted him to take the next step.

This does however make it known as to what is going on and information becomes available federally, in which this act is still completely illegal. Supposedly the federallies will not target small operations thanks to Obama as they have better things to do. Unfortunately this is bullshit, as there were federal agents at all the recent Colorado raids. I have not heard if there were charges made or not, but any raids and frequent police involvement in an operation that is still pretty much illegal, definately has myself waiting until new laws are made and precedence is set IN STONE before I leave my cave dwelling. But that is just me.

Though this would be the best time to get into it if you didn't have much to lose......

Just my 2 cents, please take it with a grain of salt and look up information for yourself, research, and research. Good luck, and I wish you and your friend the best. The more people out there doing it make it much harder to stop- though they may still try.

How do I become a care-giver?
The only way to become a care-giver is to have a patient list you as such. Registered medical marijuana patients may select one adult (age eighteen years or older) resident of Colorado to be their primary care-giver. The selection is documented either on the patient’s original application form or on a change of care-giver form.
Effective August 30, 2009, the Registry will no longer be sending revised registration cards solely on the basis of a change of care-giver.
A
patient may change care-givers at any time for any reason.
A
patient is not required to have a care-giver. It is an option for the patient.
I
t is up to the patient to notify a person that the patient has removed them as a care-giver. The Registry does not send any notice to the care-giver.
T
here is no separate registration process for care-givers.
T
here is no separate application form for the care-giver.
T
he Registry does not maintain a listing of individuals interested in becoming a care-giver.
A
patient may not be their own care-giver.
T
he patient’s physician may not be their care-giver.
T
he care-giver must be a person, not a business, corporation, etc.
T
here is no specific training or other requirement the care-giver must meet other than being selected by a patient.
o
EXCEPTION: For patients who are less than 18 years of age, the primary care-giver must be a parent residing in Colorado.
If a patient lists you as their care-giver, the Registry recommends that you retain:
1.
A copy of the registration card listing you as the care-giver; OR
2.
A copy of the application form or change of care-giver form that lists you as the care-giver, AND
3.
A copy of proof of mailing the forms to the Registry.

You need to contact the cdphe and add him as your caregiver. all you need is his contact info name, address, etc. i think they will need to reissue your card to you with the new changes as well
