The lord works in mysterious ways....first he wills you to be raped, doesn't let your body automatically purge itself of the child, then the state lets the rapist sue for custody and/or visitation rights.

How would that make you feel being required to share the kid with someone who raped you, your daughter, or other family member??

In the wake of Todd Akin's comments about pregnancy rarely resulting from "legitimate rape," lawyer Shauna Prewitt highlights a reality for women in that situation in a column on CNN: In a majority of states, attackers are afforded the same rights as other fathers.


Prewitt, herself a rape survivor who gave birth to a daughter as a result of her attack, explains that 31 states have no laws that bar rapists from seeking custody or visitation rights. For Prewitt that astounding fact is personal. Her rapist attempted to get custody of her daughter, "but thankfully I got lucky and his visitation rights were terminated," she said, according to a profile of her by The Am Law Daily's Brain Baxter. She added: "I'm not sure I would have made the decision I did had I known I might be tethered to my rapist for the rest of my life."


In a paper published in the The Georgetown Law Journal in 2010 — when the number of states without such laws were even greater — Prewitt argued that the absence "stems from the images and other societal rhetoric that depict the prototypical raped woman as hating her unborn child and as viewing her rape pregnancy as continuing her rape trauma." In her CNN piece, she blames it on "ignorance": Some believe that women don't raise children conceived from rape, others can't fathom a rapist wanting parental rights.
You see, nine months after my rape, I gave birth to a beautiful little girl. You could say she was conceived in rape; she was. But she is also so much more than her beginnings. I blissfully believed that after I finally had decided to give birth to and to raise my daughter, life would be all roses and endless days at the playground. I was wrong again.


It would not be long before I would learn firsthand that in the vast majority of states -- 31 -- men who father through rape are able to assert the same custody and visitation rights to their children that other fathers enjoy. When no law prohibits a rapist from exercising these rights, a woman may feel forced to bargain away her legal rights to a criminal trial in exchange for the rapist dropping the bid to have access to her child.

I dont see why everyone turns to the legal system in this country when they need help.

These things need to be dealt with outside of our legal system. Monsters have no rights, including the right to live.

the rapist would have to confess to RRRRAPE before he could sue for custody, and felons in prison have very slim chances in family court.

your cited anecdote does not specify if the RRRRRRAPE service porovider was an Actual RRRRRRRAPER or if the broad in question simply had a drunken one night stand, and later acquired a serious case of buyers remorse.

the RRRRRRRAPER would also have to monitor his RRRRRRRRAPE clients to see if any of them delivered his RRRRRAPE-SEMEN bonus package before he could sue for the return of his now matured "investment" in RRRRRRRAPE!

I have a feeling that most judges and juries would not grant custody most rape situations...

While she was permitted by a court to give up her rights to the child, the rapist retained his and then sought child support payments from her," the lawyer writes. "Another survivor, who gave birth to twins after a date rape, raised them peacefully with her intimate partner until they were five years old, at which time the rapist learned of their existence and filed a lawsuit to establish his paternity and gain visitation rights, and attempted to use the mother's sexual orientation against her in the legal proceedings."

Neither of those examples give the results of the lawsuits. Again they have the chance to sue, not the likelyhood of winning.

I'll agree that Todd Akin's an idiot. but to imply he is somehow to blame for an obvious deficiency in the law doesn't make any sense. He's not smart enough to know about the problem. Odd, he's still doing well in the polls.

I am against the legislative branch impinging on the authority of the judicial branch of government.

Whenever you make blanket laws there can be problems.

second, this article throws around the word RAPE like it's going out of style, yet the court recods show STATUTORY RAPE which unlike FORCIBLE RAPE generally denotes a willing "victim". the mere fact that she and her parents are suing for child support is what caused the judge to send the issue to family court in his "strongly worded" decision to send the case to the proper venue.

the "victim" apparently cut a deal to keep the "perpetRRRRaper" out of jail specifically to sue for child support. this doesnt seem odd to you? further the perp got probation on the "victim's" request so he could in fact pay the child support.

sounds like somebody came up snakeyes in the babymomma lottery, not a jaycee dugard situation.

i still doubt these claims like a motherfucker.

too much babymomma drama, not enough prison terms for this shit to be real actual rapists rather than chicks who just want to turn the screws and put a dude's nutz in a vise.

its statutory rape because a 14 yearold cannot give consent to a 20 yearold however "willing" you think she was

this whole its not "rape" "rape" spiel isnt very beffiting
