Will police need to care for pot plants seized under new laws?

Canadians should not be allowed to grow pot at home while the kinks of cannabis legalization are worked out, the heads of two policing organizations told Canadian senators on Thursday.

Senators studying the government’s proposal to create a framework to legalize pot heard that unclear language in the Liberal bill to legalize marijuana has some police officers scratching their heads as to whether they could be required to care for plants seized under the new regulations.

The policing organizations also suggested that there should also be limits on how much marijuana it is legal to possess in a single dwelling.

“What we want to see is a more gradual approach,” said Gatineau Police Chief Mario Harel, president of the Canadian Association of Chiefs of Police.

Harel said the organization he leads wants to see the legislation being studied now amended to remove clauses that would allow for Canadians to grow up to four marijuana plants at home for their own consumption. Police are worried this poses the potential for youth to be more exposed to a product that will still be illegal for them to consume.

Language under Section 102 of the bill, regarding when individuals will have the right to request the return of their pot plants following police seizure, also has police confused.

The wording states that “a peace officer, inspector or prescribed person that seizes, finds or otherwise acquires cannabis or chemical offence-related property … may return it to the person that is its owner or that is entitled to its possession if the peace officer, inspector or prescribed person is satisfied.”

Harel said that raises questions about what police may reasonably be expected to do to ensure the potential return of seized plants.

“Under the bill, it says we have to return the plants — are we going to have to look after them?”

As well, he warned that a lack of guidelines on how much marijuana can be stored on a single dwelling will leave police unable to act in cases where they believe someone is stockpiling pot to sell illegally.

The bill, as it is written now, allows for a limit of 30 grams of dried cannabis per adult for their own consumption, but does not say how much could technically be stored in a residence. Police say that leaves them in a grey area when it comes to trying to prosecute those stockpiling for criminal purposes before they actually commit illegal distribution.

“We feel there is a gap,” Harel said.

Harel’s concerns were echoed by Tom Stamatakis, president of the Canadian Police Association.

“We see this as an opportunity where a large amount of dried product may be at a residence for distribution illegally,” he said.

Deputy Chief Mike Serr, who serves on the drug advisory committee of the Canadian Association of Chiefs of Police, said the government needs to make sure limits are clear and potential loopholes are closed before the legislation passes.

Any loopholes will be exploited by the roughly 300 organized criminal groups that are involved in the marijuana black market in Canada, he said.

“Putting some limitations and restrictions would make our job easier and assist us,” Serr said.

“Organized crime will not just walk away from this issue.”

Legalizing marijuana was among the core campaign promises made by Prime Minister Justin Trudeau and he has said the government remains committed to a pledge to legalize marijuana this summer.

Mark Holland, the parliamentary secretary to the minister of public safety, said last week on The West Block that legalization is on track for the “end of summer,” which could push the date for when Canadians can actually legally buy pot into September.

Senators, however, face a deadline of June 7 to get the bill through the Red Chamber under a timeline agreed upon by Senate leadership and the government in order to hit that goal of summer legalization.

The study of the legislation is expected to continue for several more weeks.

I first and foremost I want to see the legal limitation on booze storage in your home....you never know who may be stock piling booze to sell illegally... I guess the cops hands are tied on that one too............nope
oh what's that??? your can store as much as you want to purchase...for the liquor boards province to province..

It almost sounds like the cops think if store more than than 30 grams... leaves them with some sort of job to root out those who may have say 2 oz in the residence....

Are they for real....? I thought 30 grams was the amount you could carry on your person while in public.
but it seem the cops think that this is open for interpretation....cause its not...and its also not anyone's business
how much cannabis you purchase or store....nor should 30 grams be some kind of personal limit....

If I went to a cannabis store and wanted to purchase my whole years supply in one shot....that should be no problem...nor should
I have to make 52 trips to the cannabis store..to purchase what I may want to use....

If I choose to go the the LCBO...and purchase 10 cases of 40 oz'ers and 20 cases of 24 beers...
are you able to transport this to your residence?...of course you are...

They really do believe that some how this is a fair law.....

and why they'll be after med folks all over again..but next time. We will be able to use the studies THEY ARE DOING NOW .... against them! ;)

The pigs have definitely demonstrated they are worthy of no respect in this whole legalization debacle! Fighting to be able to retain the right to arrest you at every corner! Spreading lies about the "weed" being poisoned with campaigns designed to get you to buy from their buddies, while their buddies are allowed to poison with illegal pesticides and are not punished by government agencies!

Fighting to be able to use totally unscientific and unconstitutional road-side tests to put you in jail for using a legal substance while being unable to prove impairment!

Fighting to retain some vestige of illegality to coerce and enforce against the common man!

ALL THIS, whilst at the highest levels they are cashing in on the legalization, being granted buddy licenses that no one else can get. Starting companies to cash in on the weed, whilst campaigning to keep most aspects illegal and creating more offenses to put you in jail!

I have never had to call the goons "to protect me" in my life, and I wouldn't likely ever call them. They just cause trouble and make the situation worse for everyone involved. That's been my experience.

pot is more and more legal everyday, you live under the sunshine with the freedom to do just about whatever you want, yet you are still unhappy.

i've been targeted by cops, arrested, incarcerated, and was not too pleased about it at the time.

but they were just doing their jobs, even tho i sure thot they were wasting their time chasing some fricken pothed.

and if i didnt want to be fucked with in the station by some 'bad cops', well then maybe i shudnt have been enuff of a dik to get arrested. lessonlearned, no more arrests, no more abuse by cops. simple equation. i finally passed math!!!!!!!!!!!!!!

get arrested, or get in front of a pissy copper, and it's your fault if they fuck you up. not theirs. jail is not a country club. its jail.

remember jail bro, the place with the bars.

point is my pot loving friend, if they were not there, you would need more than goons to keep your stash safe.

Also, safe to say, when i was 18 my view of the coppers was much different than it is now.

THOUGH THE POLICE...may have a place in the grand scheme of things...
they do very little to protect the medical grower and his garden...and in my experience the police view the medical grower as just another almost criminal...and not worthy of more than being patronized...in the event ....some one breaks in....
I'm still waiting to hear back from the police in regards to my breakin.....should I hold my breath...?????
did they ever intend to make a bust....I mean I gave them clear video, the guys green sign number of his house....the bad guys name and DNA sample....and the weapons he left on scene.. in other words I solved my breakin for them...and they did not have the decency
to at least investigate.....the guy...
so he still sits up the street from me,,,5 or 6 lots...and I would take matters in my own hands....but you can pretty much bet on...
if i was to go up the road....and bust this dudes head open...I would be the one getting a visit from the police...
while in the mean time....this guy walks away unscathed so far....
karma...is my best friend....as of this point....
