stabbed in neck but charged with assault and damage

man waits to speak to another (older) man after older man strikes him with vehicle after failing to stop at people crossing outside shopping centre. Older man crosses the road walks straight up to younger man and says "you had no right to do that" in broad dutch or german accent and thinking older man says "I had no right to do that , other man says "no problem, be careful you nearly ran me over" Older man says "NO, YOu had no right to do that, get away from me or I will kill you!" Man shoves older man with chest, older man feigns falling backwards, man notices keys in older mans hand and is then struck in neck with key causing skin breakage and blood loss. Man, in shock notices older man still in front of him, throws punch, does not connect. Man stands behind older mans car to prevent him from leaving, older man drives into man and leaves. Man walks a couple hundred metres and sits on a bench before noticing same car and chases it down the street. Older man drives down wrong side of street to escape. Now, people notice all this and ambulance and police called. Man is taken to hospital and wound stitched, Months later police call man and ask him to come into station to confirm some details. On arrival man is arrested and interview is conducted where man reiterates original complaint made. Police say that older man was approached by younger man after younger man "hit" his side mirror. Younger man 'smelt like alcohol' and was yelling at older man and younger man pushed older man to the ground where younger man threw punches at older man. The wound on younger man was "accident" happening during this 'attack". Younger man chased older man to car, scratched boot of car. Then chased the car about a kilometre on foot and when caught up scratched all down the side of car. Younger man denies all this. No video footage, no third party witnesses. No scratch, bruise or other injury on 'victim'. Attending police and bank manager that called them can/should attest to not smelling of or affected by alcohol. no charges laid but they say they will send summons in mail re common assault ($2000 fine/12 months max) and criminal damage (similar I think).

id see if any of those shops got a camera facing outside.. if not fuck that dude.. its all word of mouth. i wouldnt stress.. if you can grab a lawyer and your ok.. if not i still think a public defender got you

thanks buddy. yeah its very strange that no cameras at a major shopping centre (atm/shops/chemist) or maybe thney didn't want to look too hard. the only think I have that I can see is that this prick says I was drunk and reeked of alcohol, the cops that came and the bank manager that office I sat in for 30 minutes have to say I wasn't/didn't, cus I didnt. Not sure if this is that is anough to prove unreliable/bullshitting witness. Still haven't been summonsed and wondering why they wouldn't charge me at the station. :)

Are you telling me you got into a fight with an old man and he stabbed you in the neck? :shock:

havent even got the summons yet a week later so i dont even know if it will get that far. either way, worst case scenario I dont think the penalty will be very severe a year or whatever after the fact if i decide to plead guilty, sometimes its just easier to do that, but I will lawyer up for sure before I make any decisions/say anything :)

it just sucks cause i havent even got so much as a speeding fine since, and everything is going well in every other area of my life and then i think they be charging him and it shocked me when i went in there and they arrested me

you committed assault, instead of taking legal action. you are guilty. and, you said "older." I assume you don't mean 2 months older. you initiated physical aggression. you are in the wrong. take the deal.
